III. Position and functions

1. Department of Industry and Trade is an agency directly belonging to the LamDong People’s Committee. Its functions include state management of all activities related to industry and trade, such as: mechanics, metallurgy, power, new power, recycled power, chemicals, industrial explosives, mining and minerals extraction, consumer production industry; food industry, other manufacturing industries; goods transportation within the province; imports and exports; market management, competition management; trade promotion; monopoly control; anti-dumping; anti-subsidize; consumer protection; e-commerce; commerce services; economic integration; management of industrial clusters and zones; industry promotion activities; public services under the management capability of Department of Industry and Trade.

2. Department of Industry and Trade has its own legal entity, its own seal and bank account; is under the administration of the provincial People’s Committee on organization, personnel and activities; at the same time, is under the administration, guidance, inspection and examination of the Ministry of Industry and Trade.

IV. Duties and Rights

1. Submitting to the Provincial People’s Committee to issue

- General planning, 5-year and annual strategic planning; policies, programs, measures and regulations to develop industry and trade for the province.

- Decision, instructions under the authority issuance of the provincial People's Committee regarding industry and trade.

- Regulation on functions, responsibilities, authorities and organization structure of Brach Office of Market Control according to state legal regulations and instructions by the Ministry of Trade and Industry and authorized state agencies.

- Regulation on titles for head and deputy head of leaders of the Department of Industry and Trade; drafting regulation on leader titles for Division of Industry and Trade, and Division of Economics under the district’s People's Committee Office.

2. Submitting to Chairman of the People’s Committee to issue

- Decision for establishment, merger, separation, re-organization, dissolution of units within the Department of Industry and Trade.

- Other decisions and instructions on industry and trade within the issuance capability of Chairman of the People's Committee.

3. Instruct, examine the implementation of legal regulations, policies, plans, projects and programs on development of industry and trade; inform and publicize law on industry and trade.

4. Within the department’s capability, comment on draft design of projects for infrastructure development in the province; assess, issue, alter, add and withdraw licenses and certificates according to legal regulations or as authorized by the provincial People's Committee.

5. Regarding industry and small-scale industry

a. Mechanics and metallurgy: Implement plans, policies for development of mechanical industry, metallurgy, advancement of mechanical, electrical products, hi-tech products, combination of mechanical technology and automation.

b. Power:

- Implement plans for development of power, application of new power and recycled power.

- Organize training courses of law and legal regulations on power and power usage for all power units of the province; provide professional training for staff and technicians for technical units in rural power management.

- As authorized by the People's Committee, assess, examine, alter, extend, and withdraw power licenses; assist People's Committee in formulating independent power projects for the province.

- Gather information and comments on draft designs of power supply factory, power grid and transformer station.

- Implement electricity bill policy after being approved; implement policy for economical usage of power; identify conditions in which no power is supplied in low-voltage power grid (lower than 35 kV).

- Issue electricity examiner access card for power units of the province, Division of Industry and Trade in districts, and Division of Economics of Bao Loc City, Da Lat City.

- Collaborate with state agencies to inspect, examine power-related activities.

- Implement other responsibilities of state management on power as assigned by the Ministry of Industry and Trade, and the provincial People's Committee.

- Lead and collaborate with related agencies to check and solve breaches in power safety of high-voltage power grid.

c. Chemicals, industrial explosives, technically sophisticated equipment and machinery:

- Implement plans, policies for development of chemical industry, industrial explosives and technically sophisticated equipment and machinery in the province.

- As authorized by the provincial People's Committee, issue, alter and withdraw licenses for using industrial explosives.

- Lead and collaborate with related agencies to check and solve breaches in management, usage, storage and transport of chemicals, industrial explosives, liquid gas, technically sophisticated equipment and machinery.

d. Mining and mineral extraction (except minerals used for building materials and cement production)

- Lead and collaborate with related agencies to implement plans and policies for development of mining and mineral extraction activities in the province; examine the implementation of environmental protection and safety regulations in mining and mineral extraction.

- Lead and collaborate with related agencies to formulate plan for exploring, extracting and processing minerals under the authorized category of provincial People's Committee; examine the plan implementation after the plan is approved (collaborate with Department of Construction to categorize minerals for building materials and cement production in the general plan of province’s minerals).

- Within the authorized capability, lead and gather comments on draft design of construction for mining and extraction.

- Lead and collaborate with related departments to summarize, prepare statistical report on industry, minerals mining and extraction, exports of minerals in the province.

- Implement management activities on mineral industry as requested by the Ministry of Industry and Trade, and the provincial People's Committee.

e. Consumer industry, food industry and other manufacturing industries:

- Implement plans and policies for development of industrial areas: textile, leather, footwear, paper, porcelain, glass, plastic, alcoholic beverages, soft drinks, tobacco, confectionary, milk, vegetable oil, starch products.

- Instruct and examine the implementation of regulations on quality control, safety, environmental protection, food safety in the processing chain.

f. Industry promotion:

- Implement plans, projects for industry promotion in the area, including activities funded by state budget and local budget.

- Organize training courses for local staff of industry promotion units.

- Make annual plan, budget estimations for industry promotion activities; report to the provincial People's Committee so that the People's Committee will submit for approval from the People’s Council; submit to the People's Committee budget allocation plan for industry promotion activities; allocate budget within the department’s capability.

- Lead and collaborate with related departments, agencies to assess then submit to the People's Committee for approval of annual plans, projects of industry promotion; instruct the province’s Centre for Industry Promotion to implement and examine the progress after plans are approved.

g. Industrial clusters, industrial zones and small-scale industries

- Lead and collaborate with related agencies to implement plans, programs, mechanism and policies for development of small-scale industries, collective businesses in the area (including craft industries, craft village, co-operatives working in industry and trade area)

- Implement mechanism and policies providing incentives for attracting investment, import and exports, tax, finance, labor and infrastructure development, land clearance, changing of manufacturing factories, development of new industrial clusters, industrial zones and small-scale industries.

6. Trade

a. Domestic trade:

- Implement plans, mechanism, policies for development of market network, retail and wholesale market, including: markets of all types, shopping malls, supermarket chain, store chain, trade cooperatives, trade services; trade representatives, franchise, and other types of trade services.

- Lead and collaborate with related agencies to instruct organizations to implement mechanism, policies to encourage business units to expand their activities, develop business network, establish steady goods transport network in the province.

- Implement incentive mechanism and policies to encourage production, business and livelihood for people living in mountainous and remote areas in the province (for example, providing basic goods, assisting goods transports and trade services, etc.).

- Collect and analyze market information on goods circulation, total demand and supply, goods reserves and price fluctuation of basic goods for people living in mountainous and remote areas; propose to higher level agencies measures to adjust goods circulation in each period.

b. Import and export:

- Implement plans, programs, projects, policies for development and improvement of exporting activities; development of export and import services.

- Manage the exporting and importing activities of domestic businesses, and foreign businesses which do not have representative offices in Viet Nam.

c. E-commerce:

- Lead and collaborate with related agencies to build infrastructure for application of e-commerce in the province.

- Implement plans and programs; organize training courses to develop human resource for e-commerce management in the province.

d. Trade promotion:

- Implement programs, projects for trade promotion to boost export, assist businesses in building and developing Viet Nam trade mark.

- Supervise and examine the registration for organizing fairs, trade exhibition, and promotion events.

e. Market control:

- Implement measures for market control according to state regulations, instructions of the Ministry of Trade and Industry and other authorized state agencies.

- Instruct, check the businesses’ implementation of legal regulations on industry and trade; inspect businesses according to law.

- Lead and collaborate with related agencies to fight against smuggling, trading of illegal products, producing and selling counterfeit or low-quality products, products with its copyrights violated; fight against speculation activities, trade frauds of businesses in the province.

f. Competition, anti-monopoly, anti-dumping, anti-subsidize and consumer protection:

- Instruct and implement legal regulations on competition, anti-monopoly, anti-dumping, anti-subsidize and consumer protection to ensure healthy market competition; propose to related agencies to alter or add to existing regulations and documents, making them more up-to-date.

- Request related agencies or individuals to provide necessary information, documents regarding their assigned activities on competition, anti-monopoly, anti-dumping, anti-subsidize and consumer protection.

- Gather information to build database; manage, provide information about dominating businesses in the area.

g. Economic integration:

- Implement plans, programs, measures on economic integration, international trade.

- Lead and collaborate with related agencies to publicize and instruct how to implement plans, programs and regulations on economic integration, international trade of the province.

7. Assist the provincial People's Committee in state management of entrepreneurs, collective businesses, and private businesses; instruct and inspect the activities of non-governmental groups, organizations whose work related to industry and trade in the province.

8. Instruct, examine the implementation of self-control and self-responsible mechanism of independent units under the Department of Industry and Trade.

9. Implement international economic integration according to legal regulations and as instructed by the provincial People's Committee.

10. Provide professional and specialized instructions for Division of Industry and Trade in the districts’ People's Committee, Division of Economics in People's Committee of Bao Loc City and Da Lat City.

11. Organize research, application of advance technology and science in industry and trade within the department’s capability; instruct the implementation of standard, regulations regarding products quality; build data base, provide information on industry and trade according to legal regulations.

12. Implement administrative reform program of the Department of Industry and Trade within the reform schedule of provincial People's Committee.

13. Inspect, examine, solve disputes, complains; anti-corruption; practice economical activities, anti-wasting in industry and trade according to legal regulations or as authorized by the provincial People's Committee.

14. Perform public services on industry and trade within the department’s capability.

15. Regulate functions, responsibilities, authorities, organization structure, business relations of divisions and units under the Department’s of Industry and Trade; control personnel, implement salary policy, incentives, training, reward, discipline towards the department’s staff according to legal regulations and as assigned by the provincial People's Committee.

16. Control finance, assets following the legal regulations, and use budget as allocated by the provincial People's Committee.

17. Inform and report periodically or unscheduled on the implementation of regulations set by the provincial People's Committee and the Ministry of Industry and Trade.

18. Implement other responsibilities as assigned by the provincial People's Committee and law.

V. Director and vice-directors of Department

- Department of Industry and Trade has Director and no more than 03 Deputy Director. Director is the head leader, responsible in front of the provincial People's Committee, Chairman and law for the department’s activities. Deputy Director is an assistant to Director, responsible in front of Director for assigned tasks; in case of Director’s absence, one deputy is granted authority to manage the department’s activities.

- Appointment and re-appointment of Director and Deputy Director is decided by the provincial People's Committee according to professional standard set by the Ministry of Trade and Industry, and following regulations and state law on personnel. Any dismiss, reward, discipline, retirement and other policies related to Director and Deputy Director are implemented by the Department of Industry and Trade according to legal regulations.
