III. Position and Functions

 

- The Department of Home Affairs of Lam Dong Province is under the Lam Dong People’s Committee and assists it in home affairs management, including structure and organization and personnel of departments and units; administrative reforms; local governance; local administrative boundaries; civil servants at the commune levels; organizations and NGOs; archives; religion affairs; and emulation and commendation.

- The Department of Home Affairs has its own legal entity with its seal an bank account. It is under the administration of Lam Dong People’s Committee and under the management and professional guidance of the Ministry of Home Affairs.

IV. Duties and Rights

1. Submit to the Provincial People’s Committee to issue: Submit to the Provincial People’s Committee to issue decisions and instructions; long term, five-year and annual plans and projects; and programs under the management of Department of Home Affairs.

2. Publicize and guide on the authorized areas under the management of Department of Home Affairs: Organize the implementation of laws and policies, plans, projects and programs; publicize and guide on the inspection and education of laws within the areas of management of Department of Home Affairs.

3. Structure and organization

- Submit to the Provincial People's Committee on the centralization of organization to departments and units under the Provincial and District People's Committees.

- Examine and submit to the Provincial People's Committee regulations on the functions, responsibilities, rights and organization of the departments and units under the Provincial People's Committee, and the branches of the departments and units under the Provincial People's Committee; advise on projects for the establishment, merging and dissolution of units under the Provincial People's Committee.

- Examine and submit to the Provincial People's Committee decisions to establish, merge and dissolve inter-sectoral organizations as stipulated by law.

- Advise the Provincial People's Committee on projects to establish, merge and dissolve departments under the Provincial and District People's Committees so that the Provincial People's Committee would submit these projects to the Provincial People's Council for decision.

- Cooperate with relevant departments to guide District People's Committees on the regulation of the functions, responsibilities, rights and organization of the departments and units under the District People's Committees.

- Cooperate with relevant departments to guide, supervise and inspect the ranking and classification of administrative departments and units as stipulated by law.

4. Management and use of regular staff

- Prepare reports of the Provincial People's Committee on regular staff plans which are submitted to the Provincial People’s Council to decide the number of regular staff before being submitted the higher level.

- Advise the Provincial People's Committee on the allocation of regular staff to each department and unit.

- Guide the management and use of regular staff of the departments and units under the Provincial and District People's Committees.

5. Administration of Organization

- Guide the organization and operation of the local governments in the province.

- Organize and guide the professional work for the election of members of the People’s Council at all levels; cooperate with relevant bodies to organize and guide the election of members of Vietnamese National Assembly.

- Examine and submit to the Provincial People’s Committee the results of the election of chairmans and vice-chairmans of the District People’s Committees; help the Provincial People’s Council and the Provincial People’s Committee to submit to the Standing Committee of the National Assembly and the Prime Minister to approve election titles according to government regulations.

- Advise the Provincial People’s Council and the Provincial People’s Committee to train members of the People’s Councils at all levels; report on the quantity and the quality of the members of the People’s Councils and People’s Committees at all levels as stipulated by law.

6. Administrative boundaries and classification of administrative units

- Supervise and manage the administrative boundaries affairs; prepare projects and procedures relating to the establishment, merging, division and adjustment of boundaries; propose to the authorized bodies to change the names of administrative units and upgrade urban areas in the province; guide and organize the implementation of relevant decisions; help the chairman of the provincial People’s Committee to implement, guide and manage the classification of administrative units as stipulated by law.

- Manage administrative boundaries dossiers and maps as stipulated by law and instructed by the Ministry of Home Affairs.

- Guide and check the operation of residential groups as stipulated by law and instructed by the Ministry of Home Affairs.

7. Guide and check the implementation of democracy regulations: Guide and check the implementation of democracy regulations and relevant reports in wards, departments and agencies in the province.

8. Management of civil servants:

- Help the Provincial People’s Committee to manage the provincial civil servants and communal staff.

- Advise the Provincial People’s Committee to issue documents on the recruitment, management, using, training and rewarding for provincial civil servants and communal staff.

- Manage and implement the training of provincial civil servants after being approved by the Provincial People’s Committee; Guide and check the recruitment, management, using, training and rewarding for provincial civil servants.

- Submit to the chairman of the Provincial People’s Committee to decide on the recruitment, assessment, transfer, appointment, reappointment, rewards and disciplines of the civil servants who are under the direct management of the Provincial People’s Committee.

- Guide and check the implementation of regulations on the civil servants’ position criteria and structure; recruit, manage and use communal civil servants as stipulated by law and instructed by the Ministry of Home Affairs; and the centralization of civil servants’ dossiers as stipulated by law.

9. Administration reforms

- Submit to the Provincial People’s Committee to assign departments and agencies under the Provincial People’s Committee to implement administration reforms; supervise and check the implementation.

- Submit to the chairman of the Provincial People’s Committee and the Provincial People’s Committee to issues policies to promote administration reforms; cooperate with relevant agencies to implement administration reforms.

- Guide and inspect departments and agencies under the Provincial People’s Committee and district and communal People’s Committees to implement administration reforms within the administration reform plans being approved by the Provincial People’s Committee ; the implementation of one-stop and inter-sectoral one-stop shops at departments and agencies under the Provincial People’s Committee and district and communal People’s Committees as stipulated by law and directed by the Provincial People’s Committee.

- Help the Provincial People’s Committee to synthesize the implementation of regulations on the self-responsibilities for financial and personnel affairs of professional public bodies as stipulated by law.

- Report on administration reform results and present at the monthly meetings of the Provincial People’s Committee; help the Provincial People’s Committee to prepare reports to the Prime Minister and the Ministry of Home Affairs.

10. Management of organizations and NGOs

- Appraise and submit to the Provincial People’s Committee to decide on the establishment and dissolution and approve the principles of organizations and NGOs in the province as stipulated by law.

- Guide and check the compliance of principles of organizations and NGOs in the province; submit the Provincial People’s Committee to deal with the organizations and NGOs’ violations of laws and their principles.

- Coordinate with relevant departments to submit to the Provincial People’s Committee and the chairman of the Provincial People’s Committee to decide on the policies and support to organizations and NGOs as stipulated by law.

11. Documentation and archives

- Guide and check the operation of documentation and archive affairs of the provincial departments and agencies as stipulated by law.

- Guide, check, collect, preserve and use archived materials of departments and agencies and the Archive Sub-department.

- Appraise and submit to the chairman of the Provincial People’s Committee to approve the “List of sources and elements of materials to be archived by the Archive Sub-department”; examine the “List of expired materials” of the Archive Sub-department and the district archive divisions.

12. Religion affairs

- Help the Provincial People’s Committee to direct, guide, check and organize the implementation of the Party and State policies and laws regarding religion affairs in the province.

- Cooperate with relevant bodies to carry out the State management of religion affairs in the province as stipulated by law.

- Guide on religion affairs.

- Be a contact body between the local authority and religious organizations.

13. Emulation and commendation

- Advise the Provincial People’s Committee and the chairman of the Provincial People’s Committee to direct and manage the emulation and commendation affairs; implement the Party and State policies and laws regarding emulation and commendation affairs; be the standing member of the Provincial Emulation and Commendation Committee.

- Advise the Provincial People’s Committee and the Provincial Emulation and Commendation Committee to organize emulation activities and review the results; cooperate with relevant bodies to publicize ad multiply good persons and examples; organize the implementation of the Party and State policies and laws regarding emulation and commendation affairs and check the results; organize the offer of rewards and titles as stipulated by law.

- Form, manage and use the Emulation and Commendation Fund as stipulated by law; manage, offer and withdraw rewards and titles as stipulated by law.

- Guide on emulation and commendation affairs.

14. International Cooperation: Carry our international cooperation affairs in its authorized areas of management as stipulated by law and assigned by the Provincial People’s Committee.

15. Check, inspect, and deal with complaints and denouncement; prevent and fight against corruption and waste: Carry out the checking, inspection and investigation of home affairs; deal with complaints and denouncement; prevent and fight against corruption and waste as stipulated by law and assigned by the Provincial People’s Committee.

16. Guiding and advising: Guiding home affairs and relevant areas for departments and agencies under the Provincial People’s Committee and District and Communal People’s Committees; advise the Provincial People’s Committee to manage the authorized areas for central and other organizations and agencies located in the province.

17. Reporting and making statistics: Make reports and statistics as guided by the Ministry of Home Affairs regarding the organization and structure of departments and agencies, the quantity of district and communal administrative units; the quantity and quality of the civil servants; the archives, religion, emulation and commendation affairs and other areas as being assigned.

18. Research and application: Carry out research and application of scientific advances; establish the information and data system to serve the management.

19. Direction and guide: Direct and guide public administrative services within the authorized areas.

20. Reporting: Make reports to the Ministry of Home Affairs and the provincial PEOPLE’S COMMITTEE within the authorized areas.

21. Management of the organization and staff, and the implementation of policies: Manage the organization and staff; carry out salary, commendation, penalty and training policies for the civil servants within the authorized areas.

22. Financial and asset management: Manage the Department’s finance and assets as stipulated by law and assigned by the Provincial People’s Committee.

23. Decide on the functions, duties, rights, organization, work relationships and responsibilities of heads of divisions and organizations under the Department: Advise the Provincial People’s Committee on decisions of the functions, duties, rights, organization, work relationships and responsibilities of heads of divisions and organizations under the Department.

24. Other duties: Carry out other duties as stipulated by law and assigned by the Provincial People’s Committee and the chairman of the Provincial People’s Committee.

V. Director and Vice-Directors of Department

- The Department of Home Affairs of has one director and vice-directors.

- The Director is responsible for all activities of the Department within the authority of the Department.

- Vice-directors help the director and are responsible for the duties being assigned by the Directors. One vice-director is assigned to manage the Department in case the director is absent

- The appointment of the Department director and vice-directors is done by the Chairman of the Provincial People’s Committee as stipulated by law and required by the Ministry of Home Affairs. 

- The dismissal, transfer, rewarding, retirement and policies to the Department director and vice-directors is done by the Chairman of People’s Committee of Lam Dong Province as stipulated by law.
