III. Position and functions

1. The Department of Natural Resources and Environment is a body of the LamDong People’s Committee which helps the People’s Committee to carry out its State function of managing natural resources and environment. These, include: resources of land, water, mineral, environmental geology, hydrometeorology, measurement and mapping; as well as delivering public services managed by the Department of Natural Resources and Environment.

2. The Department of Natural Resources and Environment has its legal identity, own seal and account, its organization, regular officers and works are directly under the management by the provincial People’s Committee, and under the professional guidance and examination by the Ministry of Natural Resources and Environment.

IV. Duties and Rights

1. Submit to the provincial People’s Committee for promulgation

- All decisions, instructions and other documents, relating to natural resources and environment.

- Five-year and annual plans, including: programs, projects on natural resources and environment relating to, and solutions on the management and preservation of natural resources and environment in the area.

- Regulations on position criteria for the posts of the heads, deputy heads of units belonging to the Department, and the heads, deputy heads of Natural Resources and Environment Divisions of districts, cities.

2. Submit to the chairman of the provincial People’s Committee for promulgation

- Documents, relating to natural resources and environment, to be promulgated by the chairman of the provincial People’s Committee.

- Decision about the establishment, incorporation, dissolution and re-organization of professional divisions, sub-departments and service delivery units belonging to the Department of Natural Resources and Environment; Decision on stipulating functions, duties, rights and organizational structure of sub-departments belonging to the Department of Natural Resources and Environment.

- Documents stipulating details of the working relationships between the Department of Natural Resources and Environment and other relevant units, and People’s Committees of districts, cities.

3. Instruct the implementation; publicize and educate the laws on natural resources and environment: Instruct the implementation of legal normative documents, plans, programs, projects, criteria, technical standards and economic-technological evaluations in natural resources and environment, as issued by competent senior State units; publicize and educate, in the province, about the law on natural resources and environment.

4. In relation to land resource

- Preside over, and cooperate with related agencies to establish and adjust land use planning and plans at provincial level; guide and examine the implementation of land use planning and plans at levels as per approval.

- Organize the verification of land use planning and plans at district level; land use planning and plans at ward, commune levels belong to urban planning and development areas in the period of land use planning, and submit to the provincial People’s Committee for approval.

- Organize the verification of the documents of land delivery, leasing, withdrawal, land use right transfer, land use purpose alteration, and documents of issuing Certificate of land use right and ownership of property attached to the land, with regards to religious organizations, overseas Vietnamese people, foreign organizations and individuals.

- Issue the Certificate of land use right and ownership of property attached to the land as authorized by the chairman of provincial People’s Committee; sign a Contract for land leasing, make registration for land use right and ownership of property attached to the land, with regards to religious organizations, overseas Vietnamese people, foreign organizations and individuals.

- Guide and examine the implementation of the documents of land delivery, leasing, withdrawal, land use right transfer, land use purpose alteration, the issuance of Certificate of land use right and ownership of property attached to the land; the registration for land use right, setting up and management of land survey files; the implementation of land user’s rights and obligations.

- Guide, examine and organize the implementation of land investigation, survey, measurement, evaluation and classification; to set up and adjust any changes of the maps of land survey, land use actual state and planning; to total up, maintain an inventory the land and create a system of provincial land information.

- Preside over, and cooperate with related agencies to guide, examine, and implement the compensation and assistance of re-settlement to households, whose lands are taken back as stipulated by the law.

- Cooperate with related agencies to value the delivery of land use right when delivering the land, the alteration of land use purpose, the auction of land use right and projects including the land use.

- Organize and manage the operation of provincial land use right registration office, guide and examine the operation of land use right registration office at district level.

5. In relation to land valuation

- Submit to provincial People’s Committee for promulgation of programs, projects, legal normative documents on land and construction quotation, adjusting quotation of land types annually as stipulated by the law.

- Organize the implementation of legal normative documents, plans, programs, projects, criteria, technical standards and economic-technological evaluations on building, adjustment of land quotation; to propagandize and popularize the law on land quotation; guide to officials of the Division of Natural Resources and Environment to master land quotation; answer queries on building, adjustment and implementation of local land quotation.

- Investigate, make a survey and total up land types, and build the data of land price; update land price in land information system.

- Submit land survey information to the Department of Finance for a decision on land leasing price; define land use right transfer amount and submit to provincial People’s Committee.

- Periodically or unexpectedly make a report to provincial People’s Committee and the Ministry of Natural Resources and Environment of the implementation of building and adjustment of local land quotation.

- Carry out other tasks of land valuation as assigned by provincial People’s Committee.

6. In relation to water resource

- Preside, and cooperate with related agencies to set up plans for managing, using and preserving water resource, preventing water resource recession and exhaustion; organize the implementation as approved.

- Organize the verification of projects and plans for water exploitation and use, water movement among river basins as approved by provincial People’s Committee.

- Organize the definition of water exploiting restrictions to rivers, aquifers, water reservoirs, water exploiting restriction areas; plans for the regulation and allocation of water resource in the locality.

- Organize the verification of documents on extension, duration alteration, content adjustments, validity suspension and withdrawal of the permit for water resource exploration and use, the permit for waste water discharge into water source, and the permit for undersurface water drilling activities; issue a permit and charge for water resource as stipulated by the law; inspect and examine the activities relating to water resource as stipulated in those permit.

- Organize the implementation of investigations, inventories and storage of water resource data in the locality; organize and exploit monitoring works of water resource invested by the local authority.

- Summarize water exploitation and use, waste water discharge into water source in the locality; set up a list of contaminated and exhausted water source.

- Guide and examine the filling in unused wells as stipulated by the law.

- Join in the cooperation with Central Government’s joint branches if required, cooperate with the locality’s joint branches on managing, exploiting, and preserving water source at river basins.

7. In relation to mineral resource

- Preside, and cooperate with related agencies to localize restricted or temporarily restricted areas for mineral activities, define mineral exploration and exploitation areas under the competence of the provincial People’s Committee; propose solutions for mineral resource preservation to the provincial People’s Committee of solutions on mineral resource preservation.

- Organize the verification of projects on exploring mineral source for common construction materials and peat; participate in construction, exploration, processing and use of various minerals, for which the provincial People’s Committee may be able to issue the permit.

- Organize the verification of documents on the issuance, extension, withdrawal and returning of the permit for mineral activities, allowing for the transfer and continuing of the implementation of mineral activities in a case of inheritance and plans for mine closure as determined by the provincial People’s Committee.

- Organize the verification of a report about mineral exploration for common construction materials and peat as approved by the provincial People’s Committee.

- Inspect, examine and supervise mineral activities of organizations and individuals; resolve disputes, claims and illegal matters relating to mineral activities as stipulated by the law.

- Manage, store and provide information relating to mineral exploration for common construction materials and peat; total up and create an inventory of approved mineral reserves, and periodically report this to the Ministry of Natural Resources and Environment.

8. With regard to the environment

- Periodically organize and evaluate the actual state of environment in the locality; investigate and define contaminated areas, draw up a list of causes of seriously environmental contamination, and periodically report to the provincial People’s Committee and the Ministry of Natural Resources and Environment as stipulated by the law; examine the implementation of environmental contamination reduction measures by those units.

- Preside over and cooperate with related agencies to create and organize a plan for mobilizing human resource to deal with and overcome any contamination caused by environmental problems as assigned by the provincial People’s Committee.

- Carry out the issuance, extension and withdrawal of the permit to any organizations who discharge sewages, or collect, transport and deal with harmful solid wastes as stipulated by the law.

- Organize the verification of assessment reports about strategic environment, environmental impact, plans for environment protection for projects out of Industrial zones, projects for establishment of nature reserves, biodiversities as approved by the provincial People’s Committee; guide and examine the implementation after approval.

- Preside over and cooperate with the implementation of the program, plans for protecting, overcoming and improving the environmental landscapes of joint branches, preserving and sustainably developing wetlands, as assigned by the provincial People’s Committee.

- Guide the creation, organization and management of an environment monitoring system as stipulated by the law; gather and store data about the environment in the locality.

- Organize the implementation of media activities relating to environment protection within the remit of the Department of Natural Resources and Environment.

- Collect fees for verifying assessment report about the environmental impact of sewage, and environment protection measures, as stipulated by the law.

- Summarize the estimates of environment protection by provincial bodies, cooperate with the Department of Finance to report to the provincial People’s Committee and submit to the provincial People’s Council; in cooperation with the Department of Finance, manage a provincial fund for environment protection.

9. With regard to hydrometeorology

- Organize the verification of documents on the issuance, extension, adjustment of the contents, withdrawal of the operation permit of specialized hydrometeorology works in the locality, as determined by the provincial People’s Committee, and examine the implementation.

- Supervise and verify investment projects on building and improving the specialized hydrometeorology works; participate in building projects on preventing and overcoming the consequences of disasters in the locality.

- Cooperate with related units, belonging to the Central Government and local authorities, preserve and deal with any violations of the technical safety of government-owned hydrometeorology works in the locality.

- Summarize and produce a report about the impact of climate change on nature, man and socio-economic fields in the locality; in cooperation with related agencies, suggest for appropriate solutions.

10. With regard to measurement and map

- Verify documents and require competent State’s units to issue, supplement, extend and take back the operation permit of measurement and mapping, as stipulated by the law.

- Organize and manage the implementation of the measurement and mapping as per planning and plans; manage the quality of the measurement and mapping works; manage the local entire systems of the measurement and mapping documentation; manage the security, storage, provision and use of the measurement and mapping documentation; manage the preservation of the measurement and mapping building works.

- Manage and organize the implementation of creating, updating, and exploiting the measurement and mapping infrastructure system, including: systems of measurement position, geographic information, geographic names, systems of land survey mappings, administrative maps, foundation maps, specialized maps and topographic maps.

- Follow up the publication and issuance of maps, and recommend competent State’s authorities to suspend the issuance, and withdraw any with mistakes of representation of national sovereignty, administrative frontier, local geographic names, and those on technical specifications.

11. Professional guidance to officials of the district’s Division of Natural Resources and Environment, and government officers of the People’s Committees of communes, wards and towns: Give professional guides on State’s management of natural resources and environment to officials of the district’s Division of Natural Resources and Environment, and government officers of the commune’s People’s Committees.

12. Implementation of international cooperation: Implement international cooperation on management affairs of the Department of Natural Resources and Environment as stipulated by the law, and assigned or authorized by the provincial People’s Committee; supervise or carry out the verification, assessment and organization of the implementation of research topics, projects on application of technological advances relating to natural resources and the environment in the locality.

13. Guidance and examination of implementing self-control and self-reliance mechanisms to service delivery units belonging to the Department: Guide and examine the implementation of self-control and self-reliance mechanisms for the service delivery units of the Department as stipulated by the law; take responsibility for public services carried out by the Department of Natural Resources and Environment.

14. Assist the provincial People’s Committee with the State management of enterprises, collective and individual business organizations; Guide and examine the operations of NGOs: Assist the provincial People’s Committee with the State management of enterprises, collective and individual business organizations; Guide and examine NGOs’ operations on natural resources and the environment as stipulated by the law.

15. Inspect, examine and deal with violations; deal with claims and denouncements; prevent corruption: Inspect, examine and deal with any violations within the remit of the Department’s functions and duties as stipulated by the law; deal with claims and denouncements, prevent corruption as stipulated by the law and authorized by the provincial People’s Committee.

16. Stipulate functions, duties, rights, organizational structure, working relations of staff; manage regular officers and operate regimes and policies: Stipulate functions, duties, rights, organizational structure, working relations of the Department’s Office, Inspector, professional divisions and service delivery units; manage regular officers and operate regimes and policies on salaries, training, rewards, disciplines for government officials and officers managed by the Department as stipulated by the law and authorized by the provincial People’s Committee; organize professional training courses about natural resources and environment for government officers and officials responsible for State’s management at district, commune levels.

17. Manage financial affairs, assets: Manage financial affairs and assets of the Department, as stipulated by the law and authorized by the provincial People’s Committee.

18. Collect and analyze data, statistics and reports: Collect and analyze data about natural resources and environment; total up and produce a report on natural resources and environment management and preservation in the locality, as stipulated by the law.

19. Help the provincial People’s Committee to verify documents, plans and estimates; verify projects and works; verify, issue, adjust and withdraw permits, certificates: Help the provincial People’s Committee to verify documents, plans and estimates for carrying out the tasks relating to natural resources and environment in the locality as authorized; assist with or carry out the verification of projects and works relating to natural resources and environment as assigned by the provincial People’s Committee; verify, issue, adjust and withdraw permits, certificates managed by the Department of Natural Resources and Environment, as stipulated by the law, assigned or authorized by the provincial People’s Committee.

20. Cooperate with the Departments of Finance, and, Planning and Investment: Cooperate with the Departments of Finance, and, Planning and Investment to prepare submission to the provincial People’s Committee for the assignment of annual specific works and branch’s estimates. Manage and utilize the State’s budget and make sure of effectiveness as stipulated. Collect fees relating to natural resources and environment as stipulated by the law.

21. Other duties: Implement other duties as assigned by the provincial People’s Committee or stipulated by the law.

V. Director and vice-directors of Department

1. The Department of Natural Resources and Environment has a Director, and no more than three Vice-directors

2. The Director is the head of the Department, responsible for the provincial People’s Committee, the chairman of the provincial People’s Committee and responsible in law for the entire operations of the Department; responsible for reporting the operations to the provincial People’s Council, People’s Committee and the Ministry of Natural Resources and Environment, as stipulated.

3. The Vice-directors will assist and be responsible to the Director and responsible in law for their assigned tasks; in a case of the Director’s absence, one of the Vice-directors will be authorized to manage the Department’s operations.

4. The appointment of the Department’s Director and Vice-directors will be determined by the chairman of the provincial People’s Committee pursuant to professional standards published by the Ministry of Natural Resources and Environment and stipulated by the law. The removal, rewards, disciplines and other policies to the Department’s Director and Vice-directors will be acted in accordance with the State’s regulations.
