III. Position and Functions

- The Department of Construction is a professional unit of the People’s Committee of Lam Dong Province. It assists the provincial People’s Committee in implementing State administration in the fields of construction; architecture and construction planning; urban infrastructure, industrial areas, export processing areas, economic zones, hi-tech areas (including urban traffic infrastructure; water drainage and supply, waste water treatment, lighting, green trees parks, cemeteries, solid wastes in urban, industrial areas, export processing areas, economic areas, and hi-tech areas); urban development; houses and offices; real estate trading; building materials; public services relating to the Department’s State administration; and implementing other duties and rights as allocated and/or authorized by the People’s Committee of Lam Dong Province and the law.

- The Department is a legal entity which has its own seal and account. The Department operates under the control relating to organizing, personnel and work by the People’s Committee of Lam Dong Province; and also operating under the professional direction and control by the Ministry of Construction.

IV. Duties And Powers

1: Make submissions to the provincial People’s Committee for publishing the following:

- Decisions, instructions, and documents stipulating assignment, decentralization and giving authorities in terms of State administration of the Department within responsibilities and the authority of the provincial People’s Committee;

- Development of planning schedules, long-term plans - 5 year and annual programs, projects, and substantial items of works which correspond with the master plan of local socio-economic development, and regional and professional planning throughout the country;

- Construction investment projects which are under the authority of the provincial People’s Committee;

- Programs and measures to implement duties of administrative reforms in the locality to make sure that such programs and measures shall conform to targets stated in the general program of administrative reforms of the provincial People’s Committee;

- Legal documents stipulating standards for the positions of Head and/or Deputy Head of the Department’s subsidiaries, the Urban Management Unit, the Trading- Industry Unit belonging to the People’s Committee of districts, Bao Loc Town, and Da Lat City (all known as the District People’s Committee), after discussion with other relevant departments and agencies.

2: Make submissions to the provincial People’s Committee for publishing the following:

- Decisions, instructions and other documents within the authority of publishing by the chairperson of the People’s Committee in relation to State administration of the Department;

- Decisions of establishment, incorporation, separation, re-structure, dismissal of the Department’s subsidiaries according to the law.

3: Guide, check and be responsible, within the authority of the Department, for exercising legal documents, specifications, standards, development planning schedules, plans, programs projects which have been approved; publicise and disseminate laws and information relating to State administration of the Department.

4: With regard to construction

- Guide and check the implementation of the law in terms of construction, including preparation, and control the implementation of construction investment projects, survey, design, construction, inspection (quantity and quality), hand over, warranty, maintenance of the construction work according to the decentralization by the provincial People’s Committee;

- Issuance, extension, adjustment, withdrawal of a construction license, and checking the construction in the province as stated in the issued license; giving instructions and checking the issuance, extension, adjustment, withdrawal of a construction license by the People’s Committee of districts, communes and towns (all known as the People’s Committee of communes), according to the decentralization.

- Guide and check the implementation of the law in terms of conditions of construction ability of individuals/organizations (including foreign contractors, consultants and experts) participating in construction in the province; monitoring, certifying and synthesizing information of the capabilities of individuals/organizations participating in constructing in the province;

- Decentralize and control construction practicing certificates according to the law;

- Give instructions, and check the choice of construction tenders for projects belonging to the authority of the provincial People’s Committee in conformity with the Law of Construction and Tendering;

- Assist the provincial People’s Committee with duties of State administration in the quality of construction in the province; make submissions to the provincial People’s Committee for stipulating the decentralization in State administration over the quality of construction projects in the province; and give instructions for monitoring control of the quality of construction by the departments involved, the People’s Committee of districts, communes, and individuals/organizations participating in construction in the province;

- Check and inspect operations of the laboratories in construction in the province, send reports of checking and inspecting to the Ministry of Construction and make proposals for settlement of any violations according to the law;

- Monitor, synthesize, and send reports of the construction project quality management and the situation of the quality of construction work of departments/agencies, individuals/organisations involved in construction in the province;

- Superintend the quality of construction works, including any problems of construction works as decentralized by the provincial People’s Committee; monitor, synthesize and report the status of any problems of construction works in the province;

- Give instructions for making and managing costs of investment and construction in the province; make preparations for the provincial People’s Committee or the Department to proclaim such costs as per particular decentralization; construction unit prices, equipment and machinery shift unit prices, building material unit prices, survey prices, construction component and material testing prices, cost estimate standards for specific items of investment projects in the province which are not mentioned in the standards of construction published by the Ministry of Construction; and make proposals to the provincial People’s Committee, regarding applying construction standards, construction unit prices, construction price indexes, rates of investment capital for construction projects which use the local state budget;

- Guide the entities participating in construction in the province to abide by the law on construction contracts;

- Guide and organize implementation of how to submit and store survey documents, construction designs and construction finalization documents within the authority of the provincial People’s Committee in conformity with the law;

- Verify basic designs (contribute its own opinions about the basic designs) of civil construction projects, technical infrastructures, building material industry as decentralized; guide and inspect the verification of construction projects, technical designs, construction drawings, and cost estimates for construction, according to stipulations of management of construction projects;

- Organize the verification of investment projects in new urban areas in the province so that the provincial People’s Committee can submit it to the Prime Minister for approval or permission, or the People’s Committee can, within its decentralized authority, give permission for construction; organize the verification of projects to build houses in the province so that the People’s Committee can consider investing.

5: With regard to architecture and construction planning (including residential areas, urban areas, rural areas, industrial areas, export processing zones, economic zones, hi-tech areas, and key international border gates)

- Guide, inspect and organize the implementation of specification and standards of architecture; construction planning; and regulations on preparations, verification and approval of various kinds of construction planning projects;

- Organize, prepare and verify the Regulations on management of urban architecture level I; guide and cooperate with the People’s Committee of districts to prepare and verify Regulations on the management of urban architecture level II; guide and inspect implementation of the Regulations on the management of urban architecture after the Regulations are approved by the relevant authorities.

- Organize preparations and verifications of construction planning projects, and submit them to the provincial People’s Committee for approval, or organize preparations of construction planning projects carried out in the province so that the provincial People’s Committee can submit to the relevant authorities to approve, according to the law;

- Guide the People’s Committee of districts to prepare, verify and approve construction planning projects carried out in the districts as decentralized; guide the People’s Committee of communes to prepare construction planning projects for rural residential areas in the communes;

- Manage and organize the implementation of approved construction planning projects carried out in the province as decentralized, including publicizing the construction planning; control of construction survey markers and landmarks, project construction elevations; issue construction planning certificates and recommend locations of construction; provide information relating to architecture and construction planning;

- Guide and inspect the observation of laws relating to conditions for architectural practices, capabilities of individuals/organizations designing the planning of construction projects in the province.

6: With regard to technical infrastructures in urban areas, industrial areas, export processing zones, economic zones, hi-tech areas, including infrastructural structures for urban traffic; water drain and supply, waste water treatment, lighting, tree parks, cemeteries, solid wastes in urban areas, industrial areas, export processing zones, economic zones, hi-tech areas (hereinafter known as technical infrastructures).

- Lead and cooperate with relevant authorities to build policies to encourage resources, socialize development investment, manage, exploit, and supply technical infrastructure services; organize implementation of such policies after the People’s Committee has approved and issued them.

- Organize implementation of investment plans, programs and projects; and improve the effect of technical infrastructure management, expenditures for infrastructural services as shown in local socio-economic development programs approved by the relevant authorities;

- Guide, inspect and organize implementation of specifications, standards of technical infrastructures, regulations of preparations, verification and approval for various kinds of infrastructural planning projects (including water drainage and supply planning, and planning of solid waste management)

- Organize preparation, verification of various kinds of infrastructure planning projects within the authority of the provincial People’s Committee in accordance with laws; manage, and organize the implementation of planning projects after they have been approved;

- Give guidance to preparations and management of technical infrastructure service costs; organize the making of preparations so that the provincial People’s Committee proclaims or issues standards of cost estimates for technical infrastructure services in the province which are not included in the standards of cost estimates proclaimed by the Ministry of Construction, or they have been included in such standards but not in conformity with particular local technical conditions; make proposals to the provincial People’s Committee pertaining to giving instructions for the use of standards, unit prices of technical infrastructural services in the province and estimated prices of technical infrastructural services which use the State budget;

- Give guidance, inspect and synthesize the situation of control of construction investment, exploitation, use, maintenance and repair of technical infrastructures in the province as assigned by the provincial People’s Committee;

- Carry out tasks in relation of management of investment and construction of infrastructural projects in the province as assigned by the People’s Committee and in accordance with laws;

- Organize preparations and management of the system of database, and provide information of technical infrastructures in the province.

7. With regard to urban development

- Prepare planning for development of the system of urban and residential areas in the province to conform to the national planning strategy of urban areas approved by the Prime Minister; organize the implementation of such planning after they have been approved by the provincial People’s Committee;

- Lead and co-operate with relevant departments and agencies to build policies and measures to attract and encourage various resources in construction and development of synchronous and new typical urban areas, monitor the urbanization process and models of the urban management; organize the implementation after they have been approved and issued by the People’s Committee.

- Organize the implementation of urban development programs/projects (including urban area upgrading, old urban preservation and reforms; urban environment enhancement, urban management capacity improvement; and new urban area investment and development projects, …) approved by the relevant authorities as decentralized by the chairperson of the People’s Committee;

- Organize annual assessment and clarification of urban areas according to criteria stipulated by the government, and make preparation of documentation and submit them to the competent authorities to decide what class of the urban area in the province is;

- Give instructions and inspect investment and construction activities, urban development, and urban land exploitation and use in conformity to the approved planning;

- Lead and cooperate with relevant authorities to organize investment promotion activities for urban development; organize encouragement, exploitation and use of national and international resources in urban system construction, investment, and development in the province as assigned by the provincial People’s Committee.

- Organize preparations and management of the system of database, and provide information about the situation of urban development in the province.

8. With regard to houses and offices

- Produce the province’s housing development programs, housing development indexes according to each stage of the province’s socio-economic development plans; organize the implementation after they have been approved by the competent authorities;

- Lead and cooperate with relevant authorities to organize the preparation, verification, planning, and building up the system of offices for State administrative, social, political and public administrative entities; direct the implementation after they have been approved by the provincial People’s Committee;

- Give instructions and inspect the implementation of standards for construction of houses and offices; give instructions for implementation of clarification, sample designs, typical designs, and regulations of management, use, warranty, and maintenance of houses, offices in the province.

- Lead and cooperate with the Department of Finance to make preparations and submit them to the provincial People’s Committee to publicize house rent rates, unit prices of State-owned houses applicable in the province;

- Organize the implementation of tasks relating to sales of State-owned houses in compliance with Government Decree No. 61/CP dated 5 July 1994 and Government Decree No. 21/CP dated 16 April 1996 regarding selling, buying and trading in houses; giving support for improving housing conditions to those who have deserved well of the nation in accordance with the law;

- Issue house ownership certificates and construction project ownership rights as stated by the law; instruct and inspect the issuance of house ownership certificates and construction project ownership rights by the People’s Committee of districts as decentralized; monitor the process of registration and transfer of house ownership certificates and construction project ownership rights in the province;

- Lead and cooperate with relevant authorities to investigate, total up, and make periodical assessments of the situation of houses and offices in the province; prepare and control all database and provide information about State-owned houses and offices in the province;

9. With regard to real estate

- Lead and cooperate with relevant authorities to form stipulations, policies for developing and controlling real estate markets, and proper measures to make real estate transactions in the province transparent; direct the implementation after they have been approved by the provincial People’s Committee;

- Give instructions to stipulations regarding real estate being put into business; capability conditions of employers of houses, industrial park infrastructures, and new urban area projects; construction work and house buying and selling activities; residential area, industrial park infrastructure and new urban project transfer activities; and real estate business activities;

- Verify applications for transfer of the whole new urban area project, residential area and industrial area infrastructure projects, so that the provincial People’s Committee can submit it to the Prime Minister or the Provincial People’s Committee for approval.

- Inspect training and/or improvement activities relating to real estate brokerage, valuation, and real estate stock exchange management; issue and manage certificates of real estate brokerage and valuation;

- Monitor and synthesize the situation, and form the system of real estate market database, real estate business activities and trading in real estate services in the province;

- Inspect and apply penalties to any violations relating to real estate business activities and trading in real estate services as stipulated by the law.

10. With regard to building materials

- Prepare and verify the development planning of building materials in the province to ensure that the planning shall accord with the national and regional key material development planning; manage and start to direct the implementation after the planning has been approved by the provincial People’s Committee;

 - Manage and carry out plans of investigation, exploitation and processing of mineral resources to produce building materials and raw materials for cement production in the province as approved according to the law;

- Give instructions for verification and/or valuation of mineral exploiting and processing technologies to produce building materials or raw materials to produce cement; manufacturing technologies of building materials; and the quality of building materials;

- Verify investment projects for exploiting and processing minerals to produce building materials or raw materials to produce cement as decentralized by the government and the assignment by the provincial People’s Committee;

- Give instructions, inspect and carry out technical standards and regulations on labour safety and hygiene in aspects of mineral exploitation and processing to produce building materials or raw materials to produce cement; produce building materials;

- Give instructions on the law of building material business to individual(s)/organization(s) trading in building materials in the province as the assignment by the provincial People’s Committee;

- Inspect the quality of building materials used in construction of projects in the province according to the law;

- Monitor and synthesize the situation of mineral exploitation and processsing to produce building materials, or raw materials to produce cement; and the situation of building material production by individual(s)/organization(s) in the province.

11. Give instructions to and inspect operations of public-service entities under the control of the Construction Department; manage, exercise self-control policies and be responsible for administrative units under the control of the Construction Department as stipulated by the law.

12. Help the provincial People’s Committee to control businesses and collective and private economic organizations, and instruct and check activities of associations and NGO organizations in the province operating in the State aspects of which the Construction Department is in charge as stipulated by the law.

13. Participate in activities of international cooperation relating to management aspects of the Construction Department in accordance with the law and the assignment or the authority given by the provincial People’s Committee.

14. Make and organize the implementation of research plans to apply advanced scientific progress and protect the environment; build the system of information resources to strengthen the management functions and professional work assigned to the Construction Department in accordance with the law.

15. Give instructions regarding professional work of State management of the Construction Department to the Urban Management Office, the Industrial and Commercial Office under the control of the People’s Committee of Districts, and officials in charge of land-construction under the control of the People’s Committee of communes; provide inspectors with professional instructions to inspect construction works under control by the People’s Committee of Districts.

16. Inspect organizations, individuals in terms of obedience of construction laws and regulations, deal with cases of violation within the assigned authority or transfer problems to higher authorities for settlement; settle disputes, appeals, prevent corrupt practices and waste as stipulated by the law and the assignment by the provincial People’s Committee.

17. Monitor, synthesize, and periodically make six-month, yearly and extraordinary reports of the implementation of assigned tasks to the provincial People’s Committee, the Construction Ministry and other competent authorities in accordance with the law; and make statistic reports as stipulated by the Construction Ministry and the assignment by the provincial People’s Committee.

18. Stipulate functions, duties, rights and the organizational structure of Office, Inspection Unit, Professional Sub-department, and Administrative Unit which are members of the Construction Department; manage and organize the personnel structure, apply policies of salary, treatment, reward, discipline and others to employees; organize professional improvement courses for employees as stipulated by the law.

19. Manage assigned finance and assets, and carry out the State budget policy as allocated by the law and the decentralization of the provincial People’s Committee.

20. Carry out other tasks as assigned, decentralized or authorized by the provincial People’s Committee.

V. Director and Vice-Directors of Department

1. The board of leaders of the Construction Department shall have one director and no more than three vice-directors;

2. Director of the Construction Department is the head of the department and is responsible before the provincial People’s Committee, the chairperson of the provincial People’s Committee and the law for all activities of the department;

3. Vice directors of the Construction Department, who assist the director, shall be responsible for assigned tasks before the director of the department and the law; when the director is absent, the vice director to whom the authority is given by the director will run the department.

4. Appointment of someone to director and/or vice director shall be decided by the provincial People’s Committee’s chairperson in compliance with the law, and based on qualifications and professional standards issued by the Construction Ministry; removal, application of reward or discipline and others to the director and/or vice director shall comply with the law.
