Department of External Relations of Lam Dong Province

III. Position and functions

1. Department of External Relations of Lam Dong Province is a specialised agency under the management of the LamDong People’s Committee which is responsible for consulting and assisting the People’s Committee in realising State management in foreign affairs; public services within the Department’s authority of State management; and other tasks and duties in accordance with the empowerment and authorisation of the LamDong People’s Committee and the law.

2. Department of External Relations of Lam Dong Province has its own legal entity, seal and account. It works under the direction and management of the LamDong People’s Committee in organisation, personnel and tasks; and under the direction, instruction, inspection of the Ministry of Foreign Affairs in professional skills.

IV. Duties and Rights

1. To make recommendations to the LamDong People’s Committee to issue:

- Decisions, decrees and other documents relating to foreign affairs within the authority of the LamDong People’s Committee;

- Long-term, five-year and annual plans; programs and projects relating to foreign affairs; measures for implementing administrative reform in foreign affairs activities within the managing authority of the Department;

- Regulations on criteria for appointing heads and deputy heads of the Department’s affiliated units.

2. To make recommendations to the Chairman of the LamDong People’s Committee to issue:

- Decisions and decrees relating to fields of foreign affairs within the authority of the Chairman of the LamDong People’s Committee;

- Decisions on the establishment, incorporation and dissolution of the Department’s affiliated units in accordance with law.

3. To instruct, check and implement legal documents, plans, programs, projects and other issues relating to foreign affairs after those items are approved; to publicise and disseminate information about activities within the Department’s managing authority.

4. To organise and manage outbound delegations:

- To manage delegations and governmental officials going to foreign countries in accordance with law and the authorisation of the LamDong People’s Committee.

- To organise or coordinate with related agencies to organise outbound delegations of Standing Commission of Provincial Party Committee, Standing Commission of Provincial People’s Council, and Chairman and Vice Chairmans of LamDong People’s Committee.

- To collect statistics relating to outbound delegations of governmental officials working under the provincial management.

- To receive, check, and manage applications and suggest the issuing, extension, modification and supplementation of diplomatic and official passports in accordance with law and the authorisation of the LamDong People’s Committee.

5. To manage inbound delegations:

- To be authorised by the LamDong People’s Committee to consider and arrange for foreign delegations to meet with provincial agencies and localities.

Regarding delegations working in the fields of religion, ethnicity, human right or other sensitive issues, ideas of the LamDong People’s Committee and competent agencies must be consulted for instruction and direction.

- To coordinate with Office of the Provincial Party Committee, Office of the LamDong People’s Committee, Office of the Provincial National Assembly Delegation and People’s Council in receiving foreign delegations.

- To collect statistics relating to foreign delegations visiting and working in the provincial area as regulated.

6. Consular activities:

- To coordinate with relevant agencies in carrying out entry and exit activities of Vietnamese and foreign people in the province; to monitor and collect statistics relating to migration of Vietnamese and foreign people in the province; and to deal with sensitive and complicated issues arising from consular activities in the province as being authorised.

- To instruct and manage activities of foreign individuals and organisations relating to their personal identity, assets, traveling, business, investment, living, studying, and working in the province as regulated by Vietnamese law.

7. Foreign information service:

- To coordinate with relevant agencies in implementing the province’s foreign information programs and projects that are approved by the LamDong People’s Committee.

- To provide information relating to the province to serve foreign information service of the Ministry of Foreign Affairs and other competent agencies.

- To collect and analyse information relating to international and regional politics, security and international economy to serve the province’s socio-economic development.

- To manage foreign correspondents working in the province; to prepare working schedules and arrange for the provincial leaders to answer interviews; to provide oriented information; and to supervise and manage activities of foreign correspondents as regulated in law.

8. For foreign non-governmental organisations and individuals:

- To coordinate with relevant agencies in mobilising and managing grants of humanitarian, development and emergency relief programs and projects that foreign non-governmental organisations give the province in accordance with law.

- To assist with administrative procedures in implementing humanitarian, development and emergency aid given by foreign non-governmental organisations.

9. Foreign economic activities:

- To assist the LamDong People’s Committee in carrying out approved foreign affair programs to serve the province’s socio-economic development.

- To coordinate with relevant agencies and Vietnamese overseas missions to collect, select and verify foreign partners who come to do business, form ventures, realise economic cooperation and invest in the province as being authorised by the LamDong People’s Committee.

- To join hands in economic, trade, investment and tourism promotion, and in establishing an investment and business environment that are suitable for the province’s socio-economic development strategy; and to assist local enterprises in cooperating with foreign partners.

10. Foreign cultural activities:

- To implement programs of foreign cultural activities that are approved by the LamDong People’s Committee.

- To coordinate with relevant agencies in organising foreign cultural events in the province and in publicising images of local people and culture to other countries.

11. Overseas Vietnamese:

- To implement programs, plans and policies relating to overseas Vietnamese as instructed by the Ministry of Foreign Affairs.

- To coordinate with provincial departments and agencies in publicising guidelines and policies of the Vietnamese Party and State relating to overseas Vietnamese; to mobilise, instruct and assist overseas Vietnamese and their relatives in their activities in the province.

- To periodically summarise, evaluate and make recommendations to deal with issues relating to overseas Vietnamese and their relatives living in the province.

12. To organise conferences, seminars, and the signing and implementation of international agreements; to carry out the implementation of international treaties in the province:

- To act as the focal agency in instructing and receiving applications for organising international conferences and seminars in the province, and to submit those applications for the approval and decision of the LamDong People’s Committee as regulated by law.

- To manage the signing and implementation of international agreements, and the implementation of international treaties as regulated by law and authorised by the LamDong People’s Committee.

- To act as the focal agency for working and cooperating with foreign organisations, agencies and localities.

13. To implement the Department’s administrative reform in accordance with objectives and contents of administrative reform programs approved by the LamDong People’s Committee.

14. To instruct in professional skills relating to foreign affairs for staff charged of foreign affair tasks at district people’s committees.

15. To do research and apply scientific and technological achievements; to build databases, information systems and archives to serve State management and professional work in foreign affairs.

16. To check, inspect and deal with violations, complaints and accusations; to prevent and fight corruption; to practise retrenchment and prevent waste in foreign affair activities in accordance with law and the authorisation of the LamDong People’s Committee.

17. To summarise, collect statistics, provide information and make regular and unplanned reports on foreign affair situation and activities as regulated by the LamDong People’s Committee and Ministry of Foreign Affairs.

18. To report and ask for direction of the Ministry of Foreign Affairs and competent agencies to deal with arising, difficult and complicated issues in the province’s foreign affairs.

19. To stipulate functions, duties, rights and relationships of the Department’s affiliated units; to manage the Department’s organisation and structure; to carry out wage, treatment, training, appointment, exoneration, reward and punishment policies that are applicable to staff under the Department’s management in accordance with law and the authorisation of the LamDong People’s Committee.

20. To manage authorised finance and assets and to spend allocated budget in accordance with law and the authorisation of the LamDong People’s Committee.

21. To carry out other duties and rights as entrusted by the LamDong People’s Committee and Chairman of the LamDong People’s Committee and as regulated by law.

V. Director and vice-directors of Department

1. The External Relations Department has one director and two deputy directors.

2. The Director is head of the Department who shall take responsibility before the Provincial People’s Committee, Chairman of the Provincial People’s Committee and before law for all activities of the Department and for the implementation of his/her assigned functions, duties and rights.

3. Deputy Directors shall assist the Director in directing some tasks and take responsibility before the Director and before law for their assigned duties. In the absence of the Director, one Deputy Director shall be authorised by the Director to run the Department’s activities.

4. Chairman of the Provincial People’s Committee shall decide on the appointment of the Department’s Director and Deputy Directors in accordance with professional criteria issued by the Ministry of Foreign Affairs, regulations of the Party and State on personnel tasks, and law.

5. The exoneration, transfer, rotation, reward, punishment, resignation, retirement and policies applicable to Director and Deputy Directors shall be decided by Chairman of the Provincial People’s Committee as regulated by law.
