III. Position and functions

1. The Department of Justice of Lam Dong Province is under the Lam Dong People’s Committee and assists it to manage the issuance and execution of legal documents; consideration of the legality of the legal documents; publicity and propaganda of legal documents; enforcement of civil law; notarizing and judicial examination; adoption with foreigners; trade arbitration; implementation of births, deaths and marriages records, legal curriculum vitas; organization and operation of the Bar Association and law consultancy agencies; law consultancy and assistance; legal examination; conflict resolution; asset auction and other legal work as stipulated by law.

2. The Department of Justice has its own legal entity with its seal and bank account. It is under the administration of Lam Dong People’s Committee and under the management and professional guidance of the Ministry of Justice.

IV. Duties and Rights

1. Submit to the Provincial People’s Committee to issue:

- Decisions, instructions and other documents within the authority of the provincial People’s Committee in the justice area.

- Long term, five-year and annual plans and projects, programs and solutions to implement administrative reforms and juridical reforms; accomplish the legal system under the management of the Department of Justice.

- Plans for the development of law profession, notarization, asset auction and other juridical work under the management of the Department of Justice.

- Legal documents on the conditions and criteria of heads and deputy heads of divisions under Department of Justice; heads and deputy heads of divisions under District People’s Committees.

2. Submit to the chairman of the Provincial People’s Committee to issue:

- Decisions on the establishment, merging and dissolution of divisions under the management of the Department of Justice.

- Decisions and instructions under the issuing authority of the chairman of the Provincial People’s Committee in terms of the local juridical work.

3. Drafting, revising and systematizing legal documents

- Cooperate with the People's Committee Secretariat to submit to the People's Committee to approve or amend legal documents issuance plans of the Provincial People's Committee; cooperate with the Departments of Home Affairs and Finance to help the People's Committee to draft the Resolution Programs of the Provincial People’s Council.

- Cooperate with relevant departments to draft legal documents under the issuance authority of the Provincial People’s Committee.

- Examine legal document drafts to be issued by the Provincial People’s Council and the Provincial People’s Committee.

- Collect people’s opinions on legal document drafts and projects under the direction of the Provincial People’s Committee and the Ministry of Justice.

- Revise and systematize the legal documents of the Provincial People’s Council and the Provincial People’s Committee; instruct and inspect the revision of the legal documents of the District People’s Committees and departments under the Provincial People’s Committee.

4. Execution of legal documents

- Supervise the execution of legal documents in the locality.

- Instruct the supervision of the execution of legal documents of the departments under the Provincial People’s Committee and under the District People’s Committees.

- Report on the execution of legal documents in the locality and suggest solutions to difficulties in the execution of legal documents to the Provincial People’s Committee and the Ministry of Justice.

5. Inspection of legal documents

- Help the Provincial People’s Committee to inspect legal documents issued by the Provincial People’s Committee.

- Inspect the legal documents of District People’s Councils and District People’s Committees; instruct departments under the Provincial People’s Committee to inspect their legal documents; inspect the legal documents of Commune People’s Councils and People’s Committees as stipulated by law.

6. Legislation work and legal assistance to enterprises: Direct, instruct and inspect legal work of departments under the Provincial People’s Committee and Sate enterprises; implement or cooperate to implement legal assistance activities for enterprises as stipulated by law.

7. Cooperate with the Department of Culture, Sports and Tourism and relevant departments to help the Provincial People’s Committee to guide the writing of wards and residential groups’ norms and customs as stipulated by law.

8. Education and publicity of laws, conflicts resolutions

a. Education and publicity of laws

- Organize the implementation of laws education and publicity programs at the provincial level after being approved by the chairman of the Provincial People’s Committee.

- Be the standing member of the Provincial Laws Education and Publicity Board.

- Employ laws reporters; file and publish laws education and publicity materials.

- Publicize and educate laws within the authority of the Department of Justice.

- Guide the establishment, management and using of laws bookcases at commune levels and other departments as stipulated by law.

b. Conflict resolution: Guide and supervise conflict resolution at the grassroots level as stipulated by law.

9. Notarization:

- Implement the plans and programs for developing local notarizing agencies after being approved by the Provincial People’s Committee; advise and recommend the Provincial People’s Committee on measures to assist the development of notarizing agencies.

- Guide and supervise the operation of notarizing agencies at the local levels.

- Receive and check dossiers which are submitted to the Provincial People’s Committee for the establishment of notarizing agencies or the withdrawal of the notarizing agencies licenses; issue and withdraw the operation licenses of notarizing agencies.

Implement the projects for the establishment and dissolution of notarizing agencies after being approved by the Provincial People’s Committee.

- Recommend the Ministry of Justice on the appointment or dismissal of notaries.

- Guide, supervise and train notarizing agencies under the District People’s Committees and the Division of Justice and Births, Deaths and Marriages Registration under the Commune People’s Committees.

10. Births, Deaths and Marriages Registration, Nationality, Adoption with Foreigners and Criminal Records

- Direct and guide the births, deaths and marriages registration and management of the District Departments of Justice and professional civil servants of the Commune People’s Committees.

- Build the births, deaths and marriages registration and management system and train professional civil servants.

- Deal with issues of births, deaths, marriages and adoption with foreigners within its authority as stipulated by law and under the direction of the Provincial People’s Committee.

- Verify dossiers which are submitted to the Provincial People’s Committee in the areas of births, deaths, marriages and adoption with foreigners.

- Advise the Provincial People’s Committee on the withdrawal and abolishment of illegal births, deaths, marriages and adoption documents issued by the District People’s Committees.

- Manage, use and archive dossiers and forms as stipulated by law.

- Issue, manage and archive criminal records as stipulated by law.

- Investigate nationality issues and advise the Provincial People’s Committee measures to solve them as stipulated by law; manage and archive dossiers.

11. Lawyers, law consultancy, judicial appraisal and trade arbitration

a. Lawyers and law consultancy

- Verify dossiers and submit to the Provincial People’s Committee for the establishment and dissolution of Bar Associations and for the approval of the Bar Associations charters.

- Issue and withdraw Operation Registration Licenses of lawyer agencies, law consultancy centres and legal consultant certificates.

- Provide information relating to the operation of lawyer agencies and law companies to State agencies, organizations and individuals as stipulated by law; require lawyer agencies to report on their activities when necessary.

- Organize the implementation of projects and programs for the development of lawyer profession in the locality after being approved by the Provincial People’s Committee; advise the Provincial People’s Committee on measures to develop lawyer agencies.

- Train law consultancy skills.

- Guide and supervise the operation and activity of Bar Associations, lawyer agencies and law consultancy centres under its authority.

b. Judicial appraisal and trade arbitration: Help the Provincial People’s Committee in the management of judicial appraisal and trade arbitration activities as stipulated by law.

12. Legal Assistance

- Manage and guide the operation of State-owned legal assistance centres and branches and the legal assistance activity of lawyer agencies, law companies and legal assistance centres as stipulated by law.

- Train legal assistance staff in the locality.

- Issue, change and withdraw legal assistance certificates of lawyer agencies, law companies and legal assistance centres.

- Issue decision to recognize or withdraw certificates of legal assistance collaborators.

13. Auction

- Organize the planning for development of local auction organizations after being approved by the Provincial People’s Committee; advise the Provincial People’s Committee on measures to support the development of local auction organizations.

- Supervise and inspect auction activities in the locality within its authority.

14. Inspection: Organize and direct the supervision and inspection of law compliance activities within the authority of the Department of Justice; deal with complaints and denouncement; prevent and deal with corruption and waste.

15. Advise and help the Provincial People’s Committee to fulfil its duties in civil law enforcement in the locality.

16. Carry out international cooperation in terms of laws and judicial activities as stipulated by law.

17. IT application and reporting Apply IT in its activities: Make reports and statistics in the area of management as required by the Provincial People’s Committee and the Ministry of Justice.

18. Financial management and policies to its staff

- Decide the functions, duties and rights of divisions of the Department of Justice; manage staff and relevant policies for staff of the Department of Justice as stipulated by law and as being assigned by the Provincial People’s Committee.

- Guide and supervise the operation of divisions under the Department of Justice as stipulated by law.

- Carry out financial and asset management as stipulated by law and as being assigned by the Provincial People’s Committee.

19. Carry out other duties as stipulated by law and as being assigned by the Provincial People’s Committee.

V. Director and vice-directors of Department

1. The Department of Justice has one director and the maximum of 3 vice-directors.

2. The Director is responsible for all activities of the Department within the authority of the Department.

3. Vice-directors help the director and are responsible for the duties being assigned by the Directors. One vice-director is assigned to manage the Department in case the director is absent

4. The appointment of the Department director and vice-directors is done by the chairman of the Provincial People’s Committee as stipulated by law and required by the Ministry of Justice.

The dismissal, transfer, rewarding, retirement and policies to the Department director and vice-directors is done by the chairman of the Provincial People’s Committee as stipulated by law.
