III. Position and Functions

1. Department of Labour, Invalids and Social Affairs is a specialized agency of the provincial People's Committee of Lam Dong. It has the function to advise and assist the provincial People's Committees in performing the function of State management in the areas of: employment; vocational training; labor wages and remuneration, social insurance (social insurance includes compulsory and voluntary social insurance, unemployment insurance), occupational safety; heroic people; social protection, protection of and care of children, gender equality and combat social evils (referred to as field workers) of public services under the jurisdiction of the Department of Labor, War Invalids and Social Affairs and implement a number of tasks and powers as assigned, authorized by the provincial People's Committee and provisions of law.

2. Department of Labor, War Invalids and Social Affairs has legal status, seal and separate account and take the leadership, organizational management, staffing and operation of the provincial People's Committee and subject to the direction, guidance, inspection and testing of professional services of the Ministry of Labor, War Invalids and Social Affairs.

IV. Duties And Powers

1. To submit to the provincial People's Committee to issue

- Decisions, directives, planning, long-term plans, five year and annual programs, schemes and projects, administrative reform under the jurisdiction of the Department of Labor - Invalids and Social Affairs.

- On functions, tasks, powers and organizational structure of the Branches under the Department.

- To specify the standard titles for heads and deputy heads of units under the department head, deputy head of Department of Labor - Invalids and Social Affairs of the People's Committees of districts of Bao Loc, Dalat (after referred to as district people's committees) as prescribed by law.

2. Submit to Chairman of provincial People's Committee to issue.

- Decisions and directives issued under the authority of Chairman in the field of labor, social contributors and society.

- Decision on the establishment, merger and dissolution of units of the Department of Labor - Invalids and Social Affairs as prescribed by law.

3. Guides, inspects and organizes the implementation of legal documents, planning, plans, programs, proposals, projects and policies in the field of labor, heroic people and social affairs after approved, informs and propagandizes, circulates, and urges law under the management of the Department of Labor - Invalids and Social Affairs

4. In the field of employment and unemployment insurance.

a. To organize the implementation of programs and measures for employment, development policies of the provincial labor market on the basis of the national target program for employment.

b. Guide and implement the provisions of law:

- unemployment insurance;

- Targets and measures to create new jobs;

- Policies to create jobs in the enterprises, cooperatives and other forms of collective economy, private economy;

- Organize the management and use of labor, labor market information;

- Employment Policy for specific subjects (minors, the disabled, the elderly and other subjects), employees working at home, work shifting;

- Make the Level labor records and monitor the use of management and labor records.

c. Manage the job placement organization in accordance with the law.

d. Grant, renew and relocate work permits for foreign laborers who work in enterprises, economic organizations in the province as prescribed by law.

5. Regarding Vietnamese employees working overseas under contracts.

- Guide and implement the sending of laborers working in Vietnam to foreign countries under the contracts in accordance with local laws.

- Propagandize and disseminate guidelines, policies and national laws in Vietnamese laborers working overseas under contracts.

- To guide and organize the training of workforce, recruiting workers who have worked overseas under the national jurisdiction of Department of Labor - Invalids and Social Affairs.

- To guide and supervise the registration of enterprises and contracted laborers to work abroad under individual contracts and supervise the implementation of the business contract of sending laborers to work overseas in form of skill improvement.

- Make statistics on the number of enterprises operating in Vietnam to send laborers to work overseas under contracts in the province; the number of laborers to work overseas under contracts.

- Notice to end-contract laborers overseas labor demand in the country and guide, introducing the laborers to look for work register.

- Lead and coordinate with concerned agencies to address the requirements and recommendations of individuals and organizations in the field of Vietnamese laborers working in foreign countries according to their competence.

6. In the field of vocational training.

- To organize the implementation of planning, plans, programs, projects developed in local vocational training after they are approved.

- To guide and supervise the implementation of the provisions of law on vocational training standards and teacher and training managers; enrollment regulations, competition regulations, testing, accreditation and graduation diplomas and certificates; policies for administrators, teachers and vocational students, vocational students as prescribed by law.

- Guide and implement training and retraining, use teachers and vocational training instructors to organize teacher training, vocational training homemade equipment contest, good student job contest at provincial level.

7. In the field of labor, wages, payment

- Guide the implementation of labor contracts, collective labor agreements, negotiating and signing collective labor agreements; labor discipline and responsibility material and settle labor disputes and strikes; processing levels for workers in restructuring, reorganization and transformation of State enterprises, corporate bankruptcy, corporate dissolution, equities enterprises, selling securities, leasing business.

- Guide the implementation of salary or wages as prescribed by law.

8. Regarding the compulsory social insurance, voluntary social insurance

- To guide, inspect and handle violations in the implementation of the provisions of the law on compulsory social insurance, voluntary social insurance within its jurisdiction.

- Receipt of dossier evaluation and organizational conditions for temporary cessation of payment of compulsory social insurance to the PPC for review and decision.

- Implement regulations and policies on social insurance as assigned or authorized by the provincial People's Committee and provisions of law

9. In the field of occupational safety.

- Guide and implement the national program on labor protection, labor safety, labor hygiene; National Week for occupational safety, occupational sanitary and prevention of fire in the area the province.

- Organize training and certification training in occupational safety, occupational sanitary for the employer in the province.

- Implement regulations on registration of machines, equipment and materials with strict requirements on labor safety in the province as prescribed by law.

- Guidelines for quality control of products, goods-specific occupational safety in accordance with the law.

- Lead and coordinate the investigation of serious occupational accidents occurring in the area, then sum the PPC report and the Ministry of Labor - Invalids and Social Affairs on the situation of occupational accidents in localities and guide organizations and individuals make use of the labor report, investigate, make records, statistics and reports on occupational accidents.

10. Regarding people who have much contribution to the society

- Guide and implement State regulations for contributors of the revolution in the province.

- Guide and implement the construction and planning of martyrs cemetery, monuments and works of martyrs recorded in local martyrs cemetery manage the works attributed to the martyrs in the area assigned.

- Lead and coordinate the work of the filing, receiving and burying the remains of martyrs, information and news about the martyrs tombs, visiting martyrs' graves, move the remains of martyrs.

- Join the Council on Medical Evaluation of disability and working ability for the contributors of the revolution.

- Subject management and fund management on regimes performing and incentives for those who have contributed to the revolution as prescribed.

- To guide and organize the movement of gratitude, management and use of funds for gratitude of the province in accordance with the law.

11. In the field of social patronization.

- Guide the implementation of regimes and policies for social patronization beneficiaries.

- Guide and implement poverty reduction policies; national target program on poverty reduction and other programs, projects and schemes of social assistance.

- Sum up, make statistics on the number of objects of social patronization, poverty in the province.

- Build a grassroots network of social patronization in the province.

12. In the field of children protection and care.

- Guide and implement programs and action plans to protect and care for children in the province.

- To guide and supervise the implementation of the provisions of law on the protection and care of children under the jurisdiction of the Department of Labor - Invalids and Social Affairs.

- To implement the National Action Program for Children, programs, projects and national plans to protect and care for children and children with special circumstances.

- Organize, monitor, supervise and evaluate the implementation of child rights according to law regimes and policies on children protection and care.

- Manage and use of the Children Fund in accordance with provincial law.

13. In the field of social evils prevention.

- Guide and implement programs, plans and measures to prevent and combat prostitution, drug addiction and combat HIV / AIDS for subjects of prostitution, drug use in facilities and community focus VND to support community reintegration for women and children who are victims of trafficking returning from abroad.

- Instruct the professional services for the institution of social labor (management facilities for drug addicts, prostitutes, who after detoxification) in the province.

14. In the field of gender equality.

- Guide and implement policies, programs, projects and plans on gender equality when they are approved.

- Guide the integration of gender equality programs in the development and implement plans of economic development - economic development of the province, implement measures to promote gender equality in accordance with social economic conditions of the province.

15. PPC helps in performing the function of State management of enterprises, economic organizations collective, private economy, and guide and inspect the development of non-governmental organizations operating in the province in the field of laboring, and people who contribute to society and society.

16. To guide and supervise the implementation of autonomy, self-responsibility for public service units of the Department of Labor - Invalids and Social Affairs managed in accordance with the law.

17. Implement international cooperation in the field of labor, who have social contribution and society as assigned, authorized by the provincial People's Committee and provisions of law.

18. Expert guidance and professional in the field of labor, people who have social contribution and society to the Office of Labor - Invalids and Social Affairs of the district.

19. Research organization, the application of scientific and technological development databases, information systems, storage management for the State and professional services on assigned field.

20. Implement administrative reform program of the Department according to the objectives and content of administrative reform program of the PPC.

21. Inspection, testing, handling of violations under the authority and settle complaints and denunciations and combat corruption and negative; practice thrift and combat wastefulness in the field of labor, social contributors and society under the jurisdiction of the State Department of Labor - Invalids and Social Affairs as prescribed by law.

22. To organize the implementation of public services in the field of labor, social contributors and society under the jurisdiction of the State Department of Labor - Invalids and Social Affairs as prescribed by law.

23. To perform the work of gathering statistics, information, and periodic reports on the extraordinary performance of assigned tasks in accordance with the provincial People's Committee and Ministry of Labor - Invalids and Social Affairs.

24. To specify the functions, duties, powers, organizational structure and relationship of the work of organizations and business units of the Department (except for units under the jurisdiction of the Chairman); manage organization, staffing, performance and salary policies, remuneration, training and retraining, appointment, dismissal, commendation and disciplining of officials and public servants under jurisdiction of the Department of Labor - Invalids and Social Affairs under the provisions of law and decentralization of the province.

25. Financial management, asset allocation and implementation of the budget allocated in accordance with the law and the decentralization of the province.

26. Perform some other tasks assigned by the PPC and the provisions of law.

V. Director and Vice-Directors of Department

1. Department of Labor - Invalids and Social Affairs of Lam Dong province has 1 director and no more than deputy directors.

2. Director is the head of the Department, responsible to the provincial People's Committee Chairman and the law for all activities of the Department of Labor - Invalids and Social Affairs.

3. Deputy Directors of the Department are the assistant directors of the Department, responsible to the Director and the law for their assigned tasks; during the Director’s absence, a Deputy Director of the Executive Director authorized the activities of the Department.

4. The appointment of Director and Deputy Director decided by the Chairman of the PPC following professional standards and professional by the Ministry of Labor - Invalids and Social Affairs and as prescribed by law for dismissals, employees, reward and discipline regimes and policies for the Director and Deputy Director of the Department shall comply with the law.
