Decision Approving the Planning for developing the system of markets, supermarkets, and shopping centers in Lam Dong Province by 2025, with orientation to 2030. 

DECIDES

Article 1. To approve the Planning for developing the system of markets, supermarkets, and shopping centers in Lam Dong Province by 2025, with orientation to 2030 with the following contents:

I. DEVELOPMENT VIEWPOINTS

1. The development of the system of markets, supermarkets and shopping centers in the province must be in line with the province's socio-economic development master plan and the planning for development of the trade sector and other economic sectors, contributing to economic restructuring, boosting production, meeting the demands for consumption of agricultural products and consumer demands of the people.

2. The development of the system of markets, supermarkets, and shopping centers in the province is reasonable in terms of quantity and scale, not only to meet the standards and criteria of the State in the direction of civilization and modernity, but also to maintain and promote the local and typical local traditions. Improving the quality of services, operation efficiency, becoming the main commercial infrastructure system, leading the system of commercial shops of the province. Encouraging the development of supermarkets and shopping centers while restricting the construction of new markets in urban areas.

3. Developing the system of markets, supermarkets, and shopping centers in the province with the motto of strenghthening the socialization of investment, focusing on long-term interests of investors and at the same time increasing the State's support for investment in the development of market infrastructure, especially in rural and mountainous markets.

II. THE PLANNING’S OBJECTIVES

1. To develop a system of markets, supermarkets, and shopping centers in a synchronous and harmonious manner to meet the requirements of goods production and people's lives. Thereby, to promote the circulation of goods, the development of trade, industry, agriculture, tourism, and other economic sectors.

2. To step by step change the market management model in the direction of self-sustained markets; to transform the market management model from the management board or market management team to the model of enterprise or cooperative managing the market. To step by step change the shopping and consumption habits of people towards civilization and modernity, ensuring the quality, origin, food safety and hygiene, etc.

3. The planning is the basis to call for investment projects for supermarkets, markets and shopping centers in Lam Dong Province.

III. THE PLANNING’S CONTENTS

1. Market planning

By 2020, to build 27 new markets, upgrade 15 markets, move 04 markets, change the names of 05 markets. The total number of markets in the province by 2020 is 95 markets. For the 2021-2025 period, to build 15 new markets, upgrade 09, move 01 market. The total number of markets by 2025 is 109.

With vision to 2030, to relocate and to build the new Binh Thanh Market (Duc Trong District), build some new markets in communes without markets in Di Linh District, build markets in Da Oai and Phuoc Loc Communes (Da Huoai District).

2. Supermarket and shopping center planning

- By 2020, to build 04 supermarkets (not including supermarkets located in the system of shopping centers). For the 2021-2025 period, to build 06 new supermarkets. The total number of supermarkets in the province by 2025 is 12. With vision to 2030, to develop Cat Tien District's supermarket into a shopping center.

- By 2020, to build 12 new shopping centers (04 shopping centers in Da Lat and 02 in Bao Loc City have planned construction policy). For the 2021-2025 period, to build 05 new shopping centers. The total number of shopping centers in the province by 2025 is 21. With vision to 2030, to develop a shopping center in Cat Tien District.

3. Planning the system of markets, supermarkets and shopping centers according to locality

- Da Lat City: By 2020, to build 03 new markets, upgrade 01 market, move 01 market, and change names for 05 markets; to build 04 new shopping centers. For the 2021 - 2025 period, to relocate and build 01 new market and 01 new shopping center. By 2025, Da Lat will have had 16 markets, 01 specialized supermarket, and 08 shopping centers. With vision to 2030, to develop more specialized supermarkets.

- Bao Loc City: By 2020, to build 02 new markets, upgrade 02 markets and build 04 new shopping centers. In the 2021-2025 period, to build 02 new markets and 02 shopping centers. By 2025, Bao Loc City will have had 11 markets, 01 general supermarket, and 07 shopping centers. With vision to 2030, to develop more specialized supermarkets.

- Dam Rong District: by 2020, to build 03 new markets. For the 2021-2025 period, to build 01 new market. By 2025, the district will have had 05 markets. With vision to 2030, to develop general supermarkets in the district's center.

- Lac Duong District: For the 2021-2025 period, to build 01 new market. By 2025, the district will have had 02 markets. With vision to 2030, to develop general supermarkets in the district's center.

- Lam Ha District: By 2020, to build 05 new markets, upgrade 01 market and move 02 markets. For the period of 2021-2025, to build 04 new markets and 01 general supermarket. By 2025, the district will have had 13 markets and 01 general supermarket. With vision to 2030, to develop general supermarkets in the district's town.

- Don Duong District: By 2020, to build 01 new market and upgrade 03 markets; build 01 new general supermarket. For the 2021-2025 period, to build 01 new market and upgrade 01 market. By 2025, the district will have had 11 markets and 01 general supermarket. With vision to 2030, to develop general supermarkets in the district's town.

- Duc Trong District: By 2020, to build 03 new markets, upgrade 01 market; to build 01 new supermarket and 03 shopping centers. For the 2021-2025 period, to build 01 new market and upgrade 02 markets; to build 01 new general supermarket and 01 shopping center. By 2025, Duc Trong will have had 15 markets, 02 general supermarkets, and 04 shopping centers. With vision to 2030, to develop general supermarkets in new urban areas; to build and move Binh Thanh Market.

- Di Linh District: By 2020, to build 07 new markets, 01 general supermarket, and 01 shopping center. For the 2021-2025 period, to build 02 new general supermarkets. By 2025, the district will have had 12 markets, 03 supermarkets, and 01 shopping center. With vision to 2030, to build new supermarkets and markets in communes where there are not enough markets to meet the demand.

- Bao Lam District: Up to 2020, to upgrade 03 markets. For the 2021-2025 period, to build 03 new markets and 01 general supermarket. By 2025, the district will have had 07 markets and 01 general supermarket. With vision to 2030, to develop markets and supermarkets when there is demand.

- Da Huoai District: By 2020, to upgrade 01 market. For the 2021 - 2025 period, to build 01 new market and 01 shopping center. By 2025, the district will have had 04 markets and 01 shopping center. With vision to 2030, to develop markets and supermarkets when there is demand.

- Da Teh District: By 2020, to build 01 new market and move 01 market. For the 2021-2025 period, to upgrade 02 markets and build 01 new general supermarket. By 2025, the district will have had 03 markets and 01 general supermarket. With vision to 2030, to develop markets and supermarkets when there is demand.

- Cat Tien District: By 2020, to build 02 new markets, upgrade 03 markets, and build 01 new general supermarket. For the 2021-2025 period, to upgrade 04 markets . By 2025, the district will have had 10 markets and 01 general supermarket. With vision to 2030, to develop a nuclear shopping center which is an existing supermarket.

IV. LIST OF PROJECTS OUTSIDE OF THE PRIORITY INVESTMENT BUDGET

Details of investment priority projects are in the attached appendix.

V. INVESTMENT CAPITAL

- The minimum capital requirement for new construction and upgrading the system of markets, supermarkets, and shopping centers is 5.00295 trillion VND, of which: the market system needs 1,353 billion VND; the supermarket and shopping center system needs 3.64995 trillion VND.

- The estimated investment capital is mobilized mainly from enterprises, bank loans, issuing shares of enterprises, private capital, etc.

VI. SOLUTIONS TO IMPLEMENT THE PLANNING

1. On attracting and using investment capital efficiently

a) On attracting investment capital

- Central budget:

+ To utilize the Central budget supporting market investment capital according to Decree no. 02/2003/ND-CP by the Government on January 14th, 2003 on development and management of markets, and Decree no. 114/2009/ND-CP dated December 23rd, 2009 amending and supplementing some articles of Decree no. 02/2003/ND-CP dated January 14th, 2003 on development and management of markets.

+ To review and make a list of investment projects on building markets to report to the People's Committee of the province to generally combine into the medium-term public investment plans for the 2016-2020 period of the province.

- Local budget:

+ The province's budget: to develop an appropriate budget plan for ground clearance compensation and construction of transportation, electricity, and water infrastructure; to support investment on infrastructure construction (fire protection, environmental sanitation) for markets.

+ Budget of districts and cities under the province: districts/cities will actively generate revenues to build and upgrade local markets according to the planning. Market revenues (other than taxes), such as stalls for rent and services, must be managed in a uniform and strict manner, forming concentrated revenues.

- The source of investment capital outside the State budget

+ To concentrate on attracting investment capital of enterprises and cooperatives which are financially capable and experienced in commercial activities in general, and in investment, management, and exploitation of the system of supermarkets and shopping centers, in particular.

+ To promote socialization to invest in the development of the market system from a variety of sources: enterprises outside and in the markets, cooperatives, and individual households; to strengthen and take advantage of expanding sources by attracting investment capital from the aid of organizations and individuals at home and abroad.

+ To facilitate investors such as supporting for loans, investment funds, collecting fees, etc.

+ For markets in remote and poor communes where there are mainly ethnic minorities and it is difficult to invite enterprises, investing cooperatives need to focus on budget capital and call for support and grant aids of organizations, enterprises, and individuals home and abroad.

b) On using investment capital efficiently

- To study and calculate the size of each market, suitable to the needs of the business households in the market and the trade demand of people in the localities for markets funded or financially supported by the state budget or by social and political organizations. For upgraded markets, it is necessary to focus on upgrading covered stalls and business areas based on current and expected business households in the future.

- For newly constructed markets, to research and divide into several stages of investment. Phase 1 is to build business areas which are suitable to the needs of business households and items that meet the regulated standards. As the business needs of the market grow, to continue expanding the next phases.

2. On land

- Regarding shopping centers of all grades and supermarkets of grade II or higher, they are both the system of commercial infrastructure to meet the trade demands of the citizens and the modern commercial type which affects the urban image of locality, leading other types of commercial infrastructure, and also requiring large investment capital with long recovery time, therefore:

- Localities should arrange clean land funds to invite enterprises to invest in construction in accordance with the land law.

- Regarding general supermarkets of grade III and specialized supermarkets such as electronics, phones, books, food, fashion, etc., which need small land area: encouraging enterprises to find investment land; local authorities should facilitate the legal procedures for the purchase, sale, lease, or transfer of land use rights under the current land and investment laws.

- Regarding markets in rural, remote and isolated areas, which are difficult to attract enterprises to invest in developing new markets, localities need to have clean land to call for investment.

- Regarding market places which are no longer suitable to ensure traffic safety and effectiveness, it is necessary to relocate to new locations, specific solutions are as follows:

+ Localities will actively find clean land funds and land of other state-owned construction sites whose functions were transformed for investment purposes or for enterprises or cooperatives to rent and invest in.

+ Calling for businesses to find their own investment land. Local authorities facilitate legal procedures for the purchase, sale, lease, or transfer of land use rights in accordance with the current land and investment laws.

+ To ensure the business needs of enterprises, individual households, as well as the trade demand of the citizens, temporarily keeping the planned markets for relocation until new markets replace.

- Efficiently using land from old markets which are moved.

3. On fire prevention and fire fighting, environmental sanitation, and food safety and hygiene

- To study the selection of locations and designs to build the system of markets, supermarkets, and shopping centers so as to ensure compliance with regulations on fire prevention and fire fighting, environmental sanitation, distance to schools and hospitals, etc.

- To ensure the implementation of technical solutions on fire and explosion prevention in accordance with the current standards and regulations when designing and building new systems of markets, supermarkets, and shopping centers, or upgrading old infrastructure.

- To complete legal documents to ensure compliance with the conditions for business registration and compliance with standards on fire prevention and fire fighting and food hygiene and safety in the system of markets, supermarkets, and shopping centers.

- To issue regulations on applying the regime of inspecting, controlling, and sanctioning administrative violations for acts of violating fire and explosion safety principles, and on ensuring food hygiene and safety in business activities in the system of markets, supermarkets, and shopping centers.

- To regulate assignment of responsibilities and coordination of management among local departments, branches, and localities in directing and supervising fire prevention and fire fighting activities, and in ensuring environmental sanitation, and food hygiene and safety.

- To educate on and propagate fire and explosion prevention and fighting, ensuring food hygiene and safety for business households in the system of markets, supermarkets, and shopping centers, to organize professional training and fostering for officials who carry out the work of managing, propagating, and educating fire and explosion prevention and food hygiene and safety for the people in mass media.

4. On human resource training

- To step by step replace or organize the training and retraining of the managerial staff of markets, especially the markets with management boards and management teams on professional operations, on law about market business, and on the policy of improving the business efficiency of the market, gradually removing market’s subsidy.

- To organize training courses on food hygiene and safety, goods quality, anti-fake goods, quality assurance, fire and explosion prevention, etc. for enterprises, management boards and officials of markets, supermarkets, and shopping centers, and business and individual households.

- To apply Government Decree no. 56/2009/ND-CP dated June 30th, 2009 on supporting small and medium enterprises and Joint Circular no. 04/2014/TTLT-BKHDT-BTC dated August 13th, 2014, to receive funding support to train human resources for small and medium enterprises from the Central budget.

5. On improving the effectiveness and efficiency of State management

- To simplify administrative procedures on investment, and to formulate and publicize administrative procedures on investment in the system of markets, supermarkets and shopping centers in order to attract investment.

- To develop regulations on coordination among branches and levels with clear division of responsibilities between the agencies involved.

- To study policies to limit spontaneous business locations from encroaching on heavy traffic roads and sidewalks. To combine incentives, propaganda, and mobilizing these businesses to move into markets, ensuring that commercial civilization and market activities are effective.

- To strongly renovate business activities of the market system. Together with the investment in new construction, upgrading and renovation of markets, it is necessary to change the image of markets so that they are modern, civilized, clean, minimizing trade fraud, fake goods, and out of date goods in markets; not nagging customers, food markets with origin and safety, etc. To raise awareness of market management units and enterprises and households on their interests and responsibilities for markets, and to gradually erase the idea of the State subsidizing the market, first of all, in small business households in the market and part of officials and employees in market management boards and teams.

- To speed up the process of socializing markets, aiming at the objective of markets being the commercial infrastructure in which they must achieve economic efficiency, firstly, by being self-sustained. To promote the conversion of the market management model in accordance with Decision no. 723/QD-UBND dated April 4th, 2016 by the People's Committee of the province promulgating the plan to transform the market management model from the market management board or team to enterprise or cooperative market management model in Lam Dong Province in the 2016-2020 period, and by 2025, completely transformed into the enterprise or cooperative market management model.

Article 2. To organize the implementation of Planning.

1. Department of Industry and Trade, being the host for deploying and implementing the planning, is responsible for:

- Formulating annual plans, guiding, and monitoring localities in implementing the objectives, contents, and solutions of the planning.

- Advising, specifying mechanisms and policies, and mobilizing resources for the implementation of the planning.

- Regularly monitoring, inspecting and supervising the implementation, semi-annually and annually reporting the implementation results to the People's Committee of the province and the Ministry of Industry and Trade, and organizing the preliminary review, summary, and evaluation of the implementation process.

2. Relevant Departments and branches, based on their functions and tasks, direct the implementation of the contents and solutions of the planning in the province.

3. People's Committees of districts, Da Lat City, and Bao Loc City direct specialized agencies to plan the implementation of the contents and solutions, ensuring the effectiveness of the planning in their localities.

Article 3. Head of the Office of the People's Committee of the Province, Directors of Departments of: Industry and Trade, Planning and Investment, Finance, Agriculture and Rural Development, Natural Resources and Environment, Science and Technology, Labor, Invalids and Social Affairs, chairmen of the People's Committees of districts, Da Lat City and Bao Loc City, and heads of branches, agencies, and mass organizations are responsible to implement this Decision from the date of signing./.
