on administrative procedure control in 2018 of Lam Dong Province

I. OBJECTIVES AN REQUIREMENTS

1. Objectives

To implement the reform of administrative procedures in accordance with Decision no. 2827/QD-UBND dated December 28th, 2015 by the People's Committee of the province on promulgating of the reform of administrative procedures plan for the 2016-2020 period in Lam Dong Province.

To promptly publicize all administrative procedures and the list of administrative procedures according to regulations; to carry out the single-window mechanism and inter-window mechanism at relevant agencies and units while complying to settlement of administrative procedures according to regulations; 100% of complaints and petitions of individuals and organizations on administrative procedures will be handled in a timely manner. To ensure the satisfaction of the people and enterprises for the service of the administrative agencies in settling administrative procedures reaches over 85%.

The issuance of administrative procedures under the jurisdiction of the province will be controlled right from the time of request for the elaboration of legal documents and will be conducted regularly and continuously, ensuring convenience and thrift in the process of organizing the implementation. To continuously review and evaluate administrative procedures to simplify dossiers and papers, shortening implementation time; to amend and supplement the regulation on administrative procedures in accordance with the current regulations.

2. Requirements

The tasks set out are in accordance with the rules, work assignment is reasonable, complying with the functions and duties of each unit. Specifying clearly and specifically the implementation responsibility and time limit for implementation; saving costs and completing the tasks set out on schedule.

The control activities of administrative procedures must be specific and practical, contributing to raising the role and awareness of cadres, civil servants, and officials in the handling of administrative procedures, facilitating individuals and organizations to access and supervise the process of settling administrative procedures, improving the satisfaction of citizens and enterprises when participating in the settlement of administrative procedures.

Mobilizing the participation of involved agencies, units, individuals, and organizations in deployment and implementation in order to raise the quality and efficiency of control activities of administrative procedures. Promptly handling individuals and collectives that commit negative acts in settling administrative procedures.

II. THE CONTENT OF ADMINISTRATIVE PROCEDURE CONTROL

1. Directive and operational work

To issue a plan on control activities for administrative procedures as well as plans and programs for implementation of each item under the Government's direction and guidance of the Government Office so that departments, committees, branches, and localities can implement the administrative procedure control and administrative procedure reform, perform the single-window and inter-window mechanisms in dealing with administrative procedures under the jurisdiction of provincial, district, and communal levels as regulated.

To urge the implementation of tasks according to the set plans and unexpected tasks upon request; to timely solve problems and difficulties in implementing the tasks.

To continue to strengthen and consolidate the system of cadres and civil servants engaged in the control of administrative procedures at the provincial, district, and communal levels, meeting the requirements of the tasks of realizing the administrative reform objectives in 2018 and the following years.

2. Quality control of administrative procedures in drafting legal documents issued under the province's jurisdiction

To control the regulation of administrative procedures in drafting legal documents, ensuring that all draft legal documents of the People's Council and People's Committee of the province stipulating administrative procedures to be assessed for necessity, reasonability, and legality, ensuring the lowest cost of compliance.

The appraisal and comment on the regulations on administrative procedures have to meet the deadlines, adhere to the contents regulated in Decree no. 63/2010/ND-CP, Decree no. 92/2017/ND-CP, and Circular no. 02/2017/TT-VPCP dated October 31st, 2017 by the Government Office guiding the operation of administrative procedure control.

3. Announcing, publicizing, publishing, and implementing administrative procedures:

3.1. Announcing administrative procedures and the list of administrative procedures: preparing decisions on the announcement of administrative procedures and the list of administrative procedures under jurisdiction of provincial, district, and communal levels in the province based on decisions of the Ministries, ministerial-level agencies, and legal documents of the province.

3.2. Publicizing administrative procedures and the list of administrative procedures:

To post publicly, fully, and promptly the administrative procedures and the list of administrative procedures under the jurisdiction of the reception and pick-up offices at the departments, committee, branches, and localities; to publicize the administrative procedures and the list of administrative procedures on the website of the province, department, branch; People's Committees of districts.

The disclosure of administrative procedures and the list of administrative procedures must ensure accuracy, clarity, and adequacy of administrative procedures and administrative procedure components according to the announcement decision issued by the People's Committee of the province and the data extracted from the National Database for procedures in the decision announcing the list of administrative procedures. At the same time, the contents on the guidance for the implementation of feedback and requests of individuals and organizations will be publicized.

3.3. Updating, posting, connecting, and integrating data on the National Database on administrative procedures:

Importing, publicizing, integrating, exploiting, and managing the National Database on administrative procedures and the list of administrative procedures. Publicly integrating administrative procedures and the list of administrative procedures on the province’s portal.

3.4. Implementing administrative procedures

Receiving documents and settling administrative procedures according to the order and time of execution,which was already announced by the People's Committee of the province. Applying the single-window and inter-window mechanisms in the province in combination with the application of the ISO quality management system; electronic single-window; public postal services.

The process of handling administrative procedures must be closely monitored and controlled step by step by the Reception and Pick-up Office, attached to the responsibilities of individuals and units from guidance, reception, settlement, to the return of results. For past-due dossiers, there must a written apology from the agencies and organizations causing the overdue settlement to the individuals or organizations and notification for return deadlines.

4. Reviewing, evaluating, and proposing the simplification of administrative procedures

Formulating plans for reviewing and evaluating administrative procedures under the management competence and the scope of settlement by departments, committees, and branches; District People's Committees and Commune People's Committees.

Reviewing and evaluating administrative procedures is carried out in all areas according to the review and evaluation form and the compliance cost sheet, ensuring the quality of simplification plan and cost reduction rate in compliance with regulations in Chapter V, Circular no. 02/2017/TT-VPCP by the Government Office.

5. Receiving and handling feedback and requests of organizations and individuals on administrative regulations

Receiving feedback and proposals of people and enterprises sent to the Information System to receive and process feedback and requests; fully updating the feedback and requests sent in writing, by telephone, fax, or e-mail to the Information System for handling according to law provisions.

Publicizing address and telephone number to receive feedback and requests on administrative regulations; classifying, guiding, and transmitting feedback and proposals to competent state administrative agencies and individuals for handling according to law provisions. Publicizing the results of the feedback and suggestions, contributing to limiting negative impacts, facilitating citizens to participate in the settlement of administrative procedures.

6. Media communication, propaganda, and training conference

Carrying out appropriate methods to inform and propagate in order to raise the awareness of cadres, civil servants, officials, organizations, and individuals about the significance and importance of administrative procedure reform. Strengthening propaganda on the implementation of single-window and inter-window mechanisms, single-window electronic application, public postal services; reflecting and proposing the settlement of administrative procedures on mass media, facilitating individuals and organizations to study and implement. At the same time, supervising state administrative agencies, cadres, civil servants, and public employees in dealing with administrative procedures.

Cooperating with information and communication units to propagate about the administrative procedure control and the results of receiving and handling complaints on administrative regulations.

Participating in training, organizing training and professional training for departments, committees, branches, and localities to carry out administrative procedure control under the guidance of the Bureau of Administrative Procedure Control.

7. Inspecting and reporting on administrative procedure control

Regularly reviewing the implementation of administrative procedure control and administrative procedure reform in some departments; 6 district-level units and 12 commune-level units on the disclosure and settlement of administrative procedures and the implementation of single-window and inter-window mechanisms in settling administrative procedures. Promptly handling obstacles, difficulties, proposals, and requests in the implementation of administrative procedures; overcoming the shortcomings of inspected agencies, units, and individuals according to the provisions of Circular no. 02/2017/TT-VPCP by the Government Office.

Implementing the reporting regime (including the electronic reporting system) on the situation and results of the implementation of administrative procedure control and the receipt and handling of feedback and requests on regular or irregular administrative regulations according to the provisions of Circular no. 02/2017/TT-VPCP by the Government Office.

III. TASK ASSIGNMENT

1. Formulating plans and directing the implementation

1.1. Plan on administrative procedure control in 2018:

- Implementing unit: Office of the People's Committee of the province coordinates with departments, committees, branches, localities.

- Implementation time: January 2018

- Result: approval decision of the People's Committee of the province.

1.2. Building plans and programs for performing the tasks of examining and inspecting the implementation of administrative procedure control; conferences, workshops, training sessions, meetings on administrative procedure control; urging and directing the performance of tasks:

- Implementing unit: Office of the People's Committee of the province coordinates with departments, committees, branches, localities.

- Implementation time: regularly.

1.3. Consolidating the centralized system of administrative procedure control:

- Implementing unit: Office of the People's Committee of the province; District and Commune People's Committees.

- Implementation time: when there are changes.

- Result: Approval decision of the Chairman of the People's Committee of the province; chairmen of district and commune People's Committees.

2. Evaluation of the impact on administrative procedure regulations

2.1. Assessing the necessity, rationality, and legality of the administrative procedure regulations in draft legal documents of the province and collecting comments from people affected by administrative procedures (if necessary):

- Implementing unit: Agencies and units draft legal documents containing administrative procedures coordinate with the Office of the People's Committee of the province and the Department of Justice.

- Implementation time: when assigned.

- Result: the impact assessment of the administrative procedures and the table of compliance costs; result reports.

2.2. Opinions on the regulations on administrative procedures in the proposal for development of legal documents and draft legal documents:

- Implementing unit: Office of the People's Committee of the province.

- Implementation time: as proposed by the drafting units.

- Result: commentary documents.

3. Announcing, publicizing, publishing, and implementing administrative procedures:

3.1. Disclosure of administrative procedures regulated in legal documents of the province:

- Implementing unit: departments, committees, and branches cooperate with the Office of the People's Committee of the province

- Implementation time: 5 days prior to the effective date of the legal document regulating administrative procedures.

- Implementation result: Decisions by the Chairman of the People’s Committee of the province.

3.2. Announcing the list of administrative procedures under the jurisdiction of provincial, district, and communal levels in the province:

- Implementing unit: departments, committees, and branches cooperate with the Office of the People's Committee of the province.

- Implementation time: regularly.

- Result: Decisions by the Chairman of the People’s Committee of the province.

3.3. Publicizing administrative procedures, the list of administrative procedures, and the contents guiding the implementation of reports and petitions of individuals and organizations at offices, units, and localities accepting and returning results on the handling of administrative procedures:

- Implementing unit: departments, committees, and branches; District and Commune People's Committees.

- Implementation time: regularly.

- Implementation result: publicized administrative procedures and the list of administrative procedures.

3.4. Updating, posting, connecting, and integrating data on the National Database on administrative procedures:

- Implementing unit: the Office of the People's Committee of the province, Department of Information and Communications, and departments and branches in charge of industries and sectors.

- Implementation time: regularly.

- Implementation result: Publicly posting administrative procedures and the list of administrative procedures on the National Database and on the province's website.

3.5. Implementation of single-window and inter-window mechanisms:

- Implementing unit: departments, committees, and branches; District and Commune People's Committees.

- Implementation time: regularly.

- Result: administrative procedures for receipt and returning results at single-window and inter-window departments and they are fully controlled as regulated.

4. Reviewing, evaluating, and proposing the simplification of administrative procedures

4.1. Formulating plans for reviewing and evaluating administrative procedures:

- Implementing unit: Office of the People's Committee of the province; departments, committees, branches, and localities.

- Implementation time: February 2018

- Result: issued plans.

4.2. Reviewing and evaluating administrative procedures:

- Implementing unit: departments, branches, and localities; Office of the People's Committee of the province.

- Implementation time: 2nd and 3rd quarters of 2018

- Result: The forms on reviewing and calculating expenses according to regulations.

4.3. Reporting the results of reviewing and proposing a plan for simplifying administrative procedures:

- Implementing unit: departments, committees, branches, and localities report their own results; Office of the People's Committee of the province compiles for the general plan of the province.

- Implementation time: 3rd quarter of 2018

- Result: report

5. Receiving and handling feedback and requests of organizations and individuals on administrative regulations

5.1. Receiving, classifying, updating feedback and proposals, and publishing handling results on the system (https://nguoidan.chinhphu.vn/; https://doanhnghiep.chinhphu.vn/)

- Implementing unit: Office of the People's Committee of the province; departments, committees, branches, and localities.

- Implementation time: regularly.

- Result: Written reply or written document transferring feedback and requests.

5.2. Handling feedback and requests of individuals and organizations on administrative procedures transferred by the Office of the People's Committee of the province:

- Implementing unit: departments, committees, branches, and localities receiving feedback and proposals.

- Implementation time: regularly.

- Results: public response to feedback and proposals.

6. Media communication and propaganda on administrative procedure control and reform

6.1. Media communication and propaganda:

- Implementing unit: Department of Information and Communication; Radio and Television Station of Lam Dong Province; Lam Dong Newspaper; departments, committees, branches; District and Commune People's Committees.

- Implementation time: regularly.

6.2. Printing and distribution of leaflets and brochures:

- Implementing unit: Office of the People's Committee of the province

- Implementation time: 2nd and 3rd quarters of 2018

7. Organizing meetings, seminars, conferences, and training on administrative procedures

7.1. Meetings, seminars, and conferences:

- Implementing unit: Office of the People's Committee of the province coordinates with departments, committees, branches, localities.

- Implementation time: 2nd, 3rd, and 4th quarters of 2018

7.2. Training on administrative procedures for district and commune cadres and civil servants:

- Implementing unit: Office of the People's Committee of the province.

- Implementation time: 1st and 2nd quarters of 2018.

8. Inspecting and reporting on administrative procedure control

8.1. Inspecting

Coordinating the inspection of administrative reform in some departments, divisions, branches, 6 district-level units (cities: Da Lat, Bao Loc; districts: Bao Lam, Dam Rong, Lam Ha, Lac Duong), 12 commune-level units of the 6 inspected districts.

- Implementing unit: Office of the People's Committee of the province; Department of Home Affairs; inspected departments, committees, branches, localities.

- Inspection time: 2nd, 3rd, and 4th quarters of 2018

- Result: inspection records; inspection conclusion reports; reports on the situation and results from implementing the inspection conclusions.

8.2. Reporting on the situation and results of administrative procedure control and on using electronic reports on the Management and Evaluation System on administrative procedure control:

- Implementing unit: Office of the People's Committee of the province; departments, committees, branches; District People's Committees and Commune (offices, departments, and units directly implementing the administrative procedures at district level), and Commune People's Committees.

- Implementation time: Quarterly and annual reports under the guidance of Circular no. 02/2017/TT-VPCP by the Government Office.

- Result: reports.

IV. IMPLEMENTATION ORGANIZATION

1. Heads of departments, committees, branches; Chairmen of People’s Committees of districts and cities of Da Lat and Bao Loc; Chairmen of People’s of Committees communes, wards, and towns urgently implement this plan, at the same time, formulate and implement the plan on administrative procedure control in 2018 of departments, committees, branches, and localities.

2. Heads of departments, committees, branches; Chairmen of People’s Committees of districts and cities of Da Lat and Bao Loc are responsible to urge and inspect their localities and sub-units to carry out the administrative procedure control within their scope, domains, and geographical areas under their management.

To implement the reporting regime (including the electronic reporting system) on the situation and results of the implementation of administrative procedure control and on the receipt and handling of feedback and recommendations on administrative regulations regularly or irregularly and send to the Office of the People's Committee of the province for compilation according to regulations.

3. The Office of the People's Committee of the province is responsible for assisting the People’s Committee of the province to monitor and urge the implementation, and compiling reports on implementation results.

4. In the course of implementation, adjusting and implementing the tasks according to practical requirements or instructions of Central ministries and branches, to promptly propose to the People's Committee of the province for consideration and decision./.
