Direction On Enhancing The Prevention And Fighting Of Corruption 

Implementing Direction No. 25-CT/TU of the Standing Committee of the Provincial Party Committee on enhancing the leading and steering for the prevention and fighting of corruption and for effective implementation of the prevention and fighting of corruption for the next period, the Provincial People’s Committee requires departments and branches of the province, the People’s Committees of districts and the Cities of Da Lat and Bao Loc to concentrate on steering and implementation of the following key missions:

1. Enhance the dissemination, education and implementation of Direction No. 50-CT/TW of the Politburo dated 7th December 2015 on enhancing the Party’s leadership on the recognition and settlement of corruption cases; Conclusion No. 10-KL/TW of the Politburo dated 26th December 2016 on continuing the implementation of Central Resolution 3, Course X, regarding the enhancement of the Party’s leadership on preventing and fighting corruption and waste; Prime Ministerial Direction No. 12/CT-TTg dated 28th April 2016 on enhancing the recognition and settlement for corruption cases; Plan No. 05-KH/TU of the Standing Committee of the Provincial Party Committee dated 11th April 2016 on implementing Direction No. 50-CT/TW; Plan No. 19-KH/TU of the Standing Committee of the Provincial Party Committee dated 22nd February 2017 on implementing Conclusion No. 10-KL/TW; Document No. 1890-CV/TU of the Standing Committee of the Provincial Party Committee dated 1st September 2017 and Document No. 6014/UBND-NC of the Provincial People’s Committee dated 12th September 2017 on enhancing the declaration and control of property declaration and the recognition and settlement for corruption; Plan No. 434/KH-UBND of the Provincial People’s Committee dated 19th January 2018 on implementing the prevention and fighting of corruption in 2018, etc.

2. The Heads of departments and branches of the province, the People’s Committees of districts and the Cities of Da Lat and Bao Loc must define the corruption prevention and fighting as an important and regular mission of the units in association with the implementation of Central Resolution 4 (Course XI) regarding “Some urgent issues on the Party’s construction at present”, Central Resolution 4 (Course XII) regarding “Enhancing the Party’s construction and reorganization, preventing and driving back the recession of political thinking, morals and lifestyles, the acts of internal automatic occurrences and automatic conversion”, and Direction No. 05-CT/TW of the Politburo dated 15th May 2016 on “Strengthening the study of and compliance with Ho Chi Minh’s thinking, morals and style”.

Guide the synchronous and effective implementation of the solutions on corruption prevention and fighting; actively recognize cases showing signs of corruption at organizations, units and localities; timely correct shortcomings on State management affairs, effectively prevent the acts of harassment to the people and enterprises in work resolution; create significant steps in corruption prevention and fighting on both aspects of prevention and settlement; contribute to the economic development, political stability, and trust reinforcement of government officials, party members and the people in the Party’s leading and State management.

3. Effectively implement the regulations on grassroots democracy; strengthen administrative innovation, enhance the quality of administrative and public services; carry out the transfer of work positions for government officials as planned and the replacement of any officials and party members with considerably low public opinion, decreased prestige, signs of corruption, and not meeting the work requirements; specify the regulations on the code of behavior and career morals of government officials at units as regulated; reinforce and strengthen the apparatus and facilities; organize training for staff of officials in charge of corruption prevention and fighting.

4. Enhance the effectiveness of the recognition and settlement of corruption through inspection, examination, people reception and claim resolution; ensure democracy, openness and transparency in the unit’s operations; control the declaration on the property and income of government officials as regulated; actively verify and require officials to state the declaration on property and income; define the contents of declaration on property and income as one of the criteria for assessment of government officials and party members, assessment on the rate of mission fulfillment of units, localities and heads of units according to Direction No. 33/CT-TW.

5. The Provincial Inspectorate, the Inspectorates of departments and branches, the Inspectorates of districts and the Cities of Da Lat and Bao Loc must acquire information and timely propose unexpected inspections upon recognition of indications of law violation, corruption and wrong actions in implementing investment and trade projects, causing loss of State property and social confusion; concentrate on such sensitive fields with substantial public opinion concerning corruption and waste regarding land, mineral resources, basic construction investment, public property management, taxation, policies for those who rendered their service to the country, the poor and others, etc.

All inspections must clarify the causes of violations and losses, especially any cases involving signs of corruption and negative behavior or shortcomings with regards to regimes and policies which cause big losses; personalize the responsibilities of individuals; focus on the settlement of violations upon inspections to enhance the effectiveness and efficiency of the inspection and corruption prevention and fighting affairs; timely forward the investigation agency to concentrate on investigating, clarifying and strictly settling matters as regulated by law upon recognition of crimes of corruption, preventing corrupt actions showing signs of crime from only being settled by administrative discipline and penalty; apply measures to withdraw property incurred due to corrupt actions during the inspection, examination, investigation, lawsuit, trial and sentence execution.

6. The Provincial Public Security focuses on speeding up the progress of investigation, verification and settlement of cases and sentences related to economics, corruption and serious waste causing loss of the State property occurring in the province; also, cooperates with related units in receiving notifications, denouncement, verification, investigation, lawsuit and trial for corruption cases and sentences; actively cooperates with procedure executing agencies and related units to timely deal with difficulties and problems during the resolution of complicated economic and corruption cases and sentences which take a long time in the locality.

7. Timely commend and reward organizations and individuals who have high performance in corruption prevention and fighting affairs; offer measures to protect those who have denounced corruption actions; strictly treat any actions of revenge upon those who have denounced corruption or taking advantage of the denouncement to divide internal union and slander the other.

8. The Provincial Inspectorate is nominated to monitor and summarize the implementation of the legal regulations on corruption prevention and fighting of departments, branches and localities, and corruption cases and sentences arising in the province; and timely report to the Provincial Party Committee and People’s Committee as regulated./.
